A federal Court has preliminarily approved a $10.5 million class action lawsuit settlement between Intelius Inc. and consumers who say they were enrolled in membership programs without their permission and charged monthly fees. Class Members can claim a cash award of $225 and $75 worth of vouchers from the class action settlement – a combined value of $300.
The Intelius settlement resolves multiple class action lawsuits accusing the defendant of tricking consumers into signing up for membership programs while they were purchasing products from Intelius and forwarding their credit card information to other vendors without their permission.
The case is comprised of two main allegations: those related to Intelius’ “in-cart marketing” of Identity Theft subscriptions and those related to Intelius’ “post-transaction marketing” with Adaptive Marketing LLC. Claims relating to Identity Protect subscriptions have previously been settled [see “Intelius Identity Protect Class Action Lawsuit Settlement”]. This class action settlement resolves only claims relating to post-transaction marketing with Adaptive Marketing.
Plaintiffs in the class action lawsuit allege that when they purchased an Intelius product they were unwittingly enrolled in Adaptive member services. Examples of these services include, but are not limited to:
- Family Safety Report
- Privacy Matters Identity
- Privacy Matter 1-2-3
- 24 Protect Plus
- ValueMax
- Savings Ace
This service may have been listed on your credit or debit card statement using abbreviations of Adaptive Marketing or the name of any of the services.
Intelius denies the allegations but has agreed to offer refunds to consumers through a $10.5 million class action lawsuit settlement.
Class Members of the Intelius post-transaction settlement include all U.S. residents who provided credit or debit card information to a website owned, operated, or controlled by Intelius between the dates of July 2007, 2013, and August 12, 2013, and were subsequently charged for services offered through post-transaction marketing for the benefit of Intelius and/or Adaptive Marketing, and have not enabled or used any benefit associated with the service.
Class Members who submit a valid Claim Form before November 11, 2013, will be eligible to receive a cash amount of $225 and vouchers in the amount of $75.
Class Members who submit a valid Claim Form along with proof of transaction (credit card or debit card statement) will each be eligible to receive up to three times the amount each was charged for services offered through post-transaction marketing and vouchers in an amount equal to the amount each was charged for services offered through post-transaction marketing.
A Final Fairness Hearing is scheduled for November 21, 2013. Once the Final Approval Order has been signed and the time for any appeals has expired, payments will be processed within 90 days. Payments may be reduced pro rata if the total claims exceed the Net Settlement Fund and/or the Voucher Fund.

Yup I received the same email smh i sent them everything that was requested from the beginning. Yeah this is a big joke
any new updates on status of refund?
I used Intelius as a one time deal and started receiving automatic debits from MVQ Saveace. Is MVQ Saveace part of Adaptive Marketing, LLC? That was the company deducting money out of my account for $24.95 a month without my permission. When I spoke with the administrator he said he never heard of them and they were not apart of Adaptive Marketing, LLC. When I went to this link http://membershipcenter.com/index.aspx,
it looks like they are affiliated. Please advise. I had a very hard time trying to cancel the automatic drafts because I did not know where they were being drawn from nor did the bank. They have received a lot of money from my account.
I used intelus to find an address and public record of a person. The $20.00 was debited to my checking account, but then the amount kept being subtracted without my permission. Took me forever to get it straightened out! I only wanted use one time but subtractoins kept coming on my account for at least 5 lmonths before I figured it out from my bank statement
When i called they said oh but you didn’t check box on the form blah blah

The administrator above is responsible. Best part is they won’t even answer my emails regarding this matter!!! All of us listed on the email deserve to be compensated for this! Read their privacy policy- they violated their own privacy policy! Where’s the class action for us?!
They sent out a mass reply listing everyone’s email address to evryone else…no wonder they were sued in the first place
