iheart media tcpa settlement

iHeartMedia Inc. has agreed to pay $8.5 million to resolve allegations that the mass media company violated the Telephone Consumer Protection Act by sending out unsolicited text messages to its radio listeners.

According to the iHeartMedia TCPA class action lawsuit, the company sent marketing text spam to the cell phones of consumers without prior express consent, which is required under federal law.

In addition to establishing a Settlement Fund, iHeartMedia has also agreed to change its company procedures to make sure it obtains the consent of listeners to receive text messages on their cell phones before sending out advertisements.

Those who are eligible to benefit from this TCPA class action settlement include anyone who received an advertising text message from iHeartMedia (or one of its radio stations) between Oct. 16, 2013 and Apr. 19, 2016 without giving their consent ahead of time.

The $8.5 million Settlement Fund will be divided equally with all Class Members who file a valid Claim Form no later than Sept. 8, 2016.

Those who wish to object or be excluded from this class action settlement must do so by July 8, 2016.

Who’s Eligible

The iHeartMedia class action settlement is open to all Class Members in the U.S. who received an advertising text message on their cell phone from the defendant between Oct. 16, 2013 and Apr. 19, 2016.

The $8.5 million iHeartMedia Settlement Fund will be divided equally with all Class Members who file a valid and timely Claim Form before Sept. 8, 2016. The actual amount each person receives will depend on the number of total claims filed.

UPDATE 2: On August 11, 2016, the court granted the iHeart Media settlement final approval.  However, on August 31, 2016, a notice of appeal was filed.  Claims will not be paid until all appeals are resolved.  Top Class Actions will continue to provide updates as we learn more.

UPDATE 3: On Oct. 6, 2016, the settlement administrator is now reviewing claims in preparation for a distribution that is expected to occur on Nov. 10. Top Class Actions will continue to provide updates as they become available.

    its saying we don’t need to prove your number , and yes we will more then likely get rejected in the end , I got the same letter and I still have a text on my phone from them. I think they send out the letters because they need you in the class action to stay in the game in the courts then in the end you get booted even if they did text you just like the warranty group class action. I know I got calls from them its still on my messages and they have to have the clause in there to, so left everyone out, except administrators and lawyers of course they got their pay.

    I got a letter and sent in the requested information, then got a letter back saYing they sent the first letter wrong. They did not need more info. All of this after my family and I paid over 2 dollars in postage. This classaction is bogus and I can’t believe I heart media would partner with Willis from college station texas. Everybody know they are rip off people and the lawyers get all the money and customers get nothing. I heart media will be out of business if they keep aligning themselves with these scam artist tort attornys. Please iheartmedia you are losing your reputation by dealing with these people. And to all class action members if it says college station texas you will not get a check. Only the ATTORNEYS WILL get all the funds from this settlement. Please be aware. Call the better business Bureau on anything having to do with college station texas. These lawyers are scam artist and they sell info for profit to other organizations. And I really like listening to I heart radio stations. Because of these attorneys I urge you to change stations because I heart media just placed it’s rep with scam lawers.

      Shawn… I received my check, and so did quite a few others. Looks like you were incorrect in your statement. You should correct your statement to reflect the facts. This was a legit class action lawsuit and should be viewed as such.
