Players of the social casino games Huuuge Casino, Billionaire Casino and Stars Slots may be able to recoup some of their in-app purchases of virtual chips along with a portion of a $6.5 million class action settlement.

Those who may benefit from the Huuuge Casino, Billionaire Casino and Stars Slots class action settlement include individuals who played the games prior to Aug. 30, 2020.

The Huuuge Casino, Billionaire Casino and Stars Slots class action lawsuit claimed Huuuge Inc., the maker of various online slot games and apps, duped consumers into in-app purchases by offering so-called free-to-play casino games, such as slots, blackjack and poker. The complaint alleged that the app developer violated Washington state laws regarding “games of chance.”

A 2018 class action lawsuit alleged that Huuuge preyed upon consumers susceptible to gambling addictions with their free-to-play games.

According to the complaint, users were offered free chips to start playing various casino games. Once they ran out of chips, they were reportedly offered a supposed deal on thousands of more chips at a special rate to keep playing. Chips were allegedly sold for between $4.99 and $49.99 at a time.

The plaintiff says the app developer sought to exploit “the same psychological triggers as casino operators” by skirting Washington gambling laws. According to the complaint, while the majority of players do not spend money on in-app purchases, those that do spend significant amounts of money.

The class action lawsuit alleged that the players who spent money on Huuuge Casino and other gaming apps are known as “whales” in the industry and account for more than 50% of online gaming revenue.

Allegedly, the app developer exploited the tendency of certain players to “get hooked” with the initial offering of free chips and spend real money on the games that mimic gambling games in casinos.

Huuuge attempted to send the class action lawsuit to arbitration, but was denied by a federal court judge. Additionally, the company added a pop-up window requiring players to agree to arbitration as the class action lawsuit was pending.

Huuuge Casino denied any wrongdoing but agreed to pay $6.5 million in a settlement agreement to end the class action lawsuit.

In addition, the app developer has agreed to include resources for Washington residents regarding video game disorders within its apps. It will also offer an option for users to exclude themselves from the game. Further, players will be able to keep playing the games for free, without needing to purchase additional chips, under the terms of the agreement.

“Based on their comprehensive examination and evaluation of the law and facts relating to the matters at issue, Class Counsel have concluded that the terms and conditions of this Agreement are fair, reasonable, and adequate to resolve the alleged claims of the Settlement Class and that it is in the best interests of the Settlement Class Members to settle,” the settlement agreement states.

Class Members can claim a cash award, the total amount depending on the total dollar amount of in-app game purchases they made, whether their claim is subject to an arbitration provision and the total number of valid claims filed in the settlement. Class Members can get an estimate of their payment by visiting the settlement website.

Claim forms can be submitted online or by mail. A Notice ID and Confirmation Code, available on personalized Settlement Notices, is required. Alternatively, Class Members who did not receive a notice must provide their contact information and are asked to provide their Player ID number, available in the settings menu in the apps they used.

Claim forms must be submitted by Nov. 30, 2020.

The deadline to opt out of or object to the class action settlement is also Nov. 30, 2020. The final hearing is scheduled for Jan. 7, 2021.

Who’s Eligible

Individuals in the state of Washington who played Huuuge Casino, Billionaire Casino, Stars Slots and other Huuuge Social Casino Games prior to Aug. 30, 2020. 

Potential Award

Varies based on the following:

  • The total dollar amount of in-app game purchases made;
  • Whether the Class Member is subject to an arbitration agreement; and
  • The total number of claims submitted.

Proof of Purchase

A Notice ID and Confirmation Code, available on personalized Settlement Notices, is required. Alternatively, Class Members who did not receive a notice must provide their contact information and are asked to provide their Player ID number, available on the settings menu in the apps they used.
