Consumers may be able to collect a $300 voucher or $100 in cash from a settlement resolving claims that HMI Industries deceived customers with scratch-off tickets.

All individuals who received a promotional sweepstakes “scratcher” ticket identifying A-1 Allergy Relief Inc. and/or Simple Air Solutions but not identifying HMI between Sept. 9, 2009 and Jan. 2, 2018 and who purchased a Filter Queen product are considered Class Members. The HMI settlement also includes a similar Class of the same consumers from Illinois.

Plaintiff Sabra Rench filed the HMI class action lawsuit in 2013, claiming that the company sent customers scratch-off tickets that urged them to “immediately” contact the “Winner’s Hotline” to recover the prize they supposedly won.

No where on the cards did HMI identify that they were the ones sending the scratcher “so as to leave no reasonable probability that the offering might be understood,” according to Rench.

Once consumers called the hotline they were allegedly subject to lengthy sales demonstrations and unwanted purchases. Rench argued that sales associates would leave HMI products in consumers’ homes which later resulted in thousands of dollars in charges.

“Here, the scratch cards do not clearly and conspicuously disclose all material terms at the outset of the offer, including that HMI is a sponsor or that HMI products and services may be offered for sale during an hourslong, in-home presentation,” Rench argued in the HMI class action lawsuit.

The HMI class action states that the company would not have had the opportunity to foist products onto uninterested customers if they had not sent the unlawful scratcher cards. A settlement has been reached to resolve these claims and HMI has not admitted any wrongdoing.

Under the settlement, Class Members can choose to receive either $100 in cash or a $300 voucher to be used in the purchase of HMI filtration products.

In order to receive the voucher, Class Members do not have to do anything. However, if they want to collect the cash payment, they need to file a valid Claim Form by July 16, 2019.

The deadline for exclusion and objection is July 16, 2019. If a Class Member does not exclude themselves or object to the settlement by this date, they will be bound by the settlement terms and unable to contest the details of the settlement.

The final approval hearing is scheduled for Aug. 28, 2019.
