Higher One settlement

A proposed $15 million settlement has been reached in a class action lawsuit against Higher One Holdings Inc., Higher One Inc., The Bancorp Bank, Wright Express Financial Services Corporation (now known as WEX Bank), and Taylor Capital Group Inc. regarding the marketing and fees associated with the Higher One OneAccount. If you opened a OneAccount bank account between July 1, 2006 and Aug. 2, 2012, you could be eligible for benefits from the class action settlement.

The Higher One OneAccount class action lawsuit alleges that the defendants failed to disclose the refund disbursement methods available to students for their tuition and financial aid refunds. The plaintiffs also allege the defendants inadequately disclosed fees such as PIN-based transaction fees and ATM fees associated with Higher One accounts.

The defendants deny any wrongdoing but agreed to settle the OneAccount class action lawsuit to avoid the expense and uncertainty of trial.

Who’s Eligible

Class Members of the Higher One OneAccount settlement include anyone who opened a OneAccount bank account between July 1, 2006 and Aug. 2, 2012 and incurred a fee.

Potential Award

Varies. Class Members who submit valid claims will be eligible to receive a cash payment in the mail if the OneAccount class action settlement is approved. The amount of the cash payment depends on the number and type of fees incurred and the number of claims filed for the Higher One class action settlement.

Proof of Purchase

N/A. To receive a cash payment from the Higher One class action settlement, you must file a claim and provide the following information:

  • Your current address and contact information
  • Your notice number, which was provided either with the e-mail or postcard notice you received, and some other form of distinguishing information, such as the last four digits of your Social Security number, your birthday or OneAccount number.

    I WAS TOLD THAT CHECKS FROM HIGHER ONE WOULD BE MAILED OUT FEBRUARY 2015 TO ALL CLAIMANTS, IT IS 2 DAY LEFT IN THIS MONTH,TODAY IS FEBRUARY 25, 2015 AND STILL NO SETTLEMENT CHECKS HAS BEEN MAILED OUT TO ME OR ANYONE ELSE THAT I KNOW THAT HAS A CLAIM WITH HIGHER ONE. SAD

    P.S. I used used them from 2006-2012 every year and every semester. Turns out when I transferred schools Higher One is used at this school too. Trust and faith broken.

    Does anyone know how many claims they estimate on having? I am from Florida. Is this something we will have to pay taxes on? Or does it depend on amount we receive?

    The Court granted final approval on November 24, 2014 and additional information is available in the Other Legal Documents tab of this website. We estimate check distribution will take place in March 2015.

    I totally agree. I filed my claim and hope to receive something back. I had too many problems with this account. and some of the Reps couldn’t help me and when I asked for the manager she couldn’t help me either. well I’m also with a credit union and very satisfied.

    I am so happy they’re are getting sued as well! I remember when I had all my loan money through them and would get my statement and see they crazy amounts they charged me for every little thing I did with MY money……..I hope this is finalized soon….I am way too curious to see how much they ripped me off for.

    As I am transitioning from using these crooks (Higher One) to a LOCAL credit union where I can actually go into a building and see someone face-to-face. These criminals overdrafted my Higher One account because I didn’t make the “required minimum deposit” in the account and charged me a servicing fee on the account that I AM CLOSING! I’m so happy these deceivers, liars, and manipulators have been sued and even if I only get $1.00 (yes, I filed my claim), I’m satisfied in knowing these criminals have been sued.
