Real estate company Greystar agreed to pay nearly $4.7 million to resolve class action lawsuit claims surrounding improper eviction and fee practices in North Carolina.

There are two classes included in the settlement. 

The Collection Letter Class is made up of people who resided in a Greystar property in North Carolina between May 10, 2014, and June 25, 2018, and received a collection letter. The Eviction Fee Class is made up of residents of North Carolina Greystar properties between May 10, 2014, and June 25, 2018, and who were charged and paid eviction fees.

Greystar is a rental management company headquartered in South Carolina. In the United States, the company manages over 720,000 units or beds and over $23.7 billion in equity. According to the company’s website, Greystar is a leader in the rental industry.

Greystar may have taken advantage of its tenants with unfair debt collection practices, according to a class action lawsuit against a number of related companies. The Greystar class action claims the rental company violated North Carolina law by attempting to collect certain fees, penalties and other charges. 

The plaintiff in the case says Greystar regularly charged filing fees, sheriff service fees and attorneys’ fees to tenants who owed a balance. These fees were “separate and apart” from the fees allowed under North Carolina laws, the class action lawsuit contends. 

Greystar allegedly didn’t have the right to charge these fees without the fees being awarded in a court proceeding.

According to the class action lawsuit, Greystar’s actions violated North Carolina’s Residential Rental Agreements Act, Uniform Commercial Code, Debt Collection Act, Uniform Judgement Act and other state laws. 

Greystar hasn’t admitted any wrongdoing but agreed to pay $4.665 million to resolve the claims. 

Under the terms of the Greystar improper fees and eviction practices settlement, Collection Letter Class members can receive a cash payment of $50 for every collection letter they received. Class members can claim up to three letters, for a total payment of up to $150. 

The Greystart settlement also provides cash benefits for Eviction Fee Class members. This class can receive around $400 for every instance in which they were charged and paid eviction fees.

Class Members can be a member of both classes, meaning that they could be eligible for both types of compensation from the settlement.

The deadline for exclusion and objection is June 20, 2022. 

The final approval hearing for the settlement is scheduled for July 22, 2022. Class Members who wish to speak at the hearing must file a notice of intent to appear by June 27, 2022.

In order to receive benefits from the settlement, Collection Letter Class Members must submit a valid claim form by June 20, 2022. Members of the Eviction Fee Class do not have to file a claim in order to receive their benefits.

    I’m facing issues with regards to electricity in my apartment. I live in Greystar managed apartment and my building manager Laura Barragan is the worst manager I’ve ever dealt with. They keep pointing fingers at me for the electric issues. After suffering for 2 months straight I called my own electrician and managed to fix the issue and this woman sends me an email yesterday and still telling me that I was over loading the circut and that’s why it trips, the actual issue was internal wiring. And now they don’t want to refund the amount that I paid towards the electrician visit. If any attorney reading this, please get in touch with me. I have all the proofs showing that it was not a load issue and all the emails by this manager showing how ignorant she is of the truth. Thank you!

    I live in ca and I’m leasing from grey star.. so my rent went up in July which left me with a balance of back rent from the Covid funding we paid it which was a struggle.. I left a review a few weeks ago.. that same day I got a call basically saying I had no right to leave a review basically saying false information.. which clearly isn’t false cause once again I’m being told the owner is/will refuse my payment.. now I’m facing Eviction.. Was told that the owner is refusing payment even tho I just paid 5.000 in back rent..

      I am facing eviction from Greystar Nightmare Property also …
      Random late fees and I have section 8 housing so how is my rent not paid on time… office crooks I think are taking some of the ERPP money that I didn’t even apply for .. think they forged my name said I owed 16,456.86 in back rent and they got a check on the portal that since which has been updated I think to cover there government rental assistance payments .. I had two other neighbors come to me and say they had the same issues.. don’t even get me started on the Mold that the maintenance slackers literally painted over the wall where the sliding glass patio door was infested with black mold … I’ve noticed I’m feeling constant anxiety and stress causing me to feel depressed and hopeless while they try to evict me for false charges..

    Greystar bought my apt complex less than a year ago. At the end of my lease, the rent went up $250. I did a short term lease as I was planning to move. 5 weeks later, they increase that same renewal lease term by an additional $638 dollars for a unit that I have been occupying for 5 years!

      In July, my rent was $1150. They offered me a 12 month price of $1408 to renew. To do a 3 month lease was over $1600. This is just August and now the 12 month lease offer amount is $2046. $638 added to what they offered last month. The advertized price of the unit starts at $1741. I assume that is for the unrenovated unit, which is my apt. No upgrades of any kind.

    Greystar violates security deposit law I’m out of my security deposit and a number of days prorated rent too. I am a victim of assault by staff. Greystar is too few peoplè to have this amount of control of massive amounts of rental properties turning them into slums. My lease claims I do not have the right to post any reviews that says bad things about them. This is why my lease was terminated.

    Greystar is the worst management company. They are slumlords who only care about turnover. They don’t care about the tenants.

    I was robbed. They showed no remorse. They did not improve security. They just didn’t care. I live in a high rise in the City. Security should be present and robberies should not.

    Tiffany Darbouze is the worst manager. She has no clue??

    I upgraded to a larger apartment ( they manage ) they left the dirty toilet from the previous tenant. I have asked and asked for a new toilet and they refuse.

    They also gave me an oven that doesn’t work and a dishwasher that smells like melted plastic?

    They refuse to replace anything.

    If the rent is 8 days late they’re ready to evict.

    Worst company ever!!!

    I pay over $3000.00 a month in rent.
