Google will pay $100 million to resolve lawsuit claims it violated the privacy rights of consumers through Google Photos face recognition.
The settlement benefits Illinois residents who appeared in a photo in Google Photos between May 1, 2015, and April 25, 2022.
Google Photos is a way for Google users to store their photos online and access them from any device. The app allows users to search their photos by keywords, relevant Google locations and even by the names of people tagged in the photo.
Although this technology allows users to easily access their photos and find pictures of loved ones, plaintiffs in a class action lawsuit say Google oversteps with its facial recognition. According to the plaintiffs, Google’s facial recognition technology and storage of “faceprints” violates Illinois’ Biometric Information Privacy Act (BIPA).
BIPA protects Illinoisians’ right to keep their biometric information private. This information includes fingerprints, facial scans, eye scans and other biometric data.
BIPA requires businesses like Google to follow strict regulations about the collection, storage and destruction of these biometrics in order to protect consumers from identity theft and other fraud.
Google allegedly violates BIPA by using facial geometry to identify people in photos without getting consent, issuing proper disclosures and maintaining a public retention and destruction schedule.
“Google failed to obtain consent from anyone when it introduced its facial recognition technology,” the BIPA class action lawsuit contends. “Not only do the actions of Google fly in the face of FTC guidelines, they also violate the privacy rights of individuals appearing in photos uploaded to Google Photos in Illinois.”
According to the plaintiffs, these actions put them at risk for fraud related to their unsecured biometric information. The plaintiffs in the class action lawsuit sought damages from Google up to the maximum $5,000 per violation allowed under the law.
Google hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $100 million settlement. This settlement allows Google to avoid a potentially higher trial verdict while securing compensation for the plaintiffs and class members.
Under the settlement terms, class members can receive a cash payment.
Exact payment amounts will vary depending on the number of claims filed with the settlement. However, according to the Google Photos face recognition privacy settlement website, payments will likely be between $200 and $400.
Payments may be higher if fewer class members participate, or lower if the opposite is true.
The deadline for exclusion and objection is Aug. 10, 2022.
The final approval hearing for the settlement is scheduled for Sept. 28, 2022. Class Members have the opportunity to speak at this hearing but are not required to attend.
In order to recover a payment from the Google Photos face recognition privacy settlement, Class Members must submit a valid claim form by Sept. 24, 2022.

I watched the trial online. It was very interesting to me but they are giving more time for the nonapproved claims to be reexamined with more verification. I think we will get payment in the next 6 months but that is only my opinion. I hope its way sooner.

Update: On April 14, 2023, the Court ordered that the administrator continue to attempt to verify certain claims and set a Status Conference for June 2, 2023.

I had gotten an email November 24th that stated I needed to download & send them an image of my drivers license? I was not comfortable with that and chose not to. I see some posts on Reddit that shows a paragraph stating that request did NOT have to be done. Anyone know what is accurate regarding this?
Not everyone had to do it but if they asked for it – you needed to provide it. Without providing what they requested, you are not entitled to a payment. Not sure why you didn’t feel “comfortable” providing it. It’s just a settlement administrator trying to confirm that you actually are who you say you are and that you are indeed part of the settlement. You also had to provide proof of Illinois residency at the time of the settlement if you didn’t still live there. So you will not be getting a payment. Next time you need to provide what they’re asking you for if you want to remain eligible.
Its way too much to post here but if you take a look at the update on the case you can read why the case is being held up and its because of this very item.. Hope that helps!!!!!
Yes I know. I posted this comment on Jan. 2nd and I also saw the update yesterday, Jan. 5th. I read through the whole motion. Does she really think they’re going to just throw the requirement out? Lol. I mean what is she thinking? It’s a known fact that administrators can ask for proof/documentation after the fact. It even says it at the bottom of some claim forms; that proof/documentation is not needed to file a claim but the administrator reserves the right to, and may, request documentation later.
Its just another delay but this time by a Settlement member not delay by the company or the administrators. I think they will just give more time for the people to submit their information and then soon I hope send payments to everybody that’s approved.. Let the clock begin fingers crossed it won’t be too long!!!!!

Update: As of December 28, 2022, no Settlement Payments have been issue. The deadline to issue payments per the Settlement Agreement is 90 days from the Effective Date or January 26, 2023. This website will be updated once a date for distribution is set.
They knew they were not going to send any payments on Dec 27th so why did they even say it?? I just wonder what they will say in the next 30 days and still no payments???
