FedEx shipping fees class action settlementFederal Express Corp. and FedEx Corporate Services Inc. (collectively, “FedEx”) have reached a class action settlement over claims that they overcharged for deliveries to business and government offices. If you are a FedEx Express customer who paid a residential delivery charge between Aug. 28, 2008, and July 13, 2011, you may be entitled to a cash payment.

The FedEx overcharging settlement will resolve a class action lawsuit (Gokare P.C. v. Federal Express Corp.) that alleged FedEx improperly charged customers residential delivery charges on shipments to non-residential addresses.

FedEx has denied the allegations but agreed to provide cash payments to customers under a class action settlement that was preliminarily approved on Aug. 1, 2013.

Class Members of the FedEx overcharging class action settlement include all FedEx National Account Holders or Nine Digit Account holders who paid a Residential Delivery Charge, Delivery Area Residential Surcharge, Extended Delivery Area Residential Surcharge or Fuel Surcharge Component between Aug. 28, 2008, and July 13, 2011, and did not receive a full refund of the charges.

The value of each Class Member’s monetary relief will be based on whether the shipment was a “Refund Requested Shipment” and/or a “No-Refund Requested Shipment.” Eligible Class Members are expected to receive a minimum of $5, but may be entitled to a higher payment depending on their total claim. The parties agree that the class action settlement will provide at least $5 million to Class Members.

The only way to receive a cash payment from the FedEx overcharging class action settlement is to submit a valid Claim Form postmarked no later than Dec. 9, 2013. Detailed claims filing instructions are provided below.

A fairness hearing will be held on Nov. 22 to determine whether the proposed FedEx class action settlement will receive final approval.

The FedEx Overcharging Class Action Lawsuit is Gokare P.C. v. Federal Express Corp., Case No. 11-cv-02131, in the U.S. District Court for the Western District of Tennessee.

I would hope the class action will expand onto denied insurance coverage claims for lost and stolen packages. They routinely deny when they lose a package. Even after paying for adult signature required. They claim it is at the driver’s discretion. FedEx lets a recipient call and reroute the package for credit card fraud orders. Our company filed claims in excess of $15,000 in one month for ‘lost’ packages and FedEx denied the. The arrogant adjust said file a claim in court if you don’t like it. We went with Registered Mail after that. Our FedEx services went from $30,000 a year to under $500 now. But no more losses. I welcome the day the Class Action opens all the doors.
