Godiva Chocolatier will pay up to $6.3 million to settle a class action lawsuit that claimed the company’s U.S. retail stores printed receipts that included too much of the payment card number.
Anyone who made a purchase with a credit or debit card at a U.S. Godiva retail store between April 6, 2013, and Nov. 20, 2015, and received a point-of-sale receipt displaying more than the last five digits of the card number is eligible to take part in the Godiva settlement.
Class Members in the Godiva settlement who submit a valid claim form are expected to receive about $55 to $60. The final amount will depend on the number of valid claims filed.
The plaintiff who filed the class action lawsuit alleged Godiva’s willful printing of receipts that included more than the last five digits of the payment card number violated the Fair and Accurate Credit Transactions Act, or FACTA.
Congress passed FACTA in 2003 in an effort to help protect consumers from identity theft.
Without FACTA, vendors would be able to print any amount of payment card information they wanted, leaving identity thieves to potentially be able to gather multiple receipts in order to piece together information such as the whole card number and expiration date.
According to the complaint, consumers who used debit or credit cards to purchase products from Godiva “were burdened with a material risk of identity theft and other harms,” and therefore entitled to an award of damages.
Godiva allegedly printed 10 digits — the first six and the last four – of customers’ card numbers on its point-of-sale receipts.
The plaintiff said this practice increased an identity thief’s ability to carry out a “distributed guessing attack,” such as systematically attempting to make multiple online purchases using different combinations of numbers, because the last digit is a “check digit.” A check digit is a digit whose value is based on other digits appearing in the card number using an algorithm.
“This significantly limits the number of possible combinations a thief will need to attempt to discover the missing digits,” the class action lawsuit said.
The plaintiff claims he experienced the FACTA violation at various Godiva stores across the United States, including at three alls in Florida.
Godiva has denied any allegations of wrongdoing, but has agreed to a settlement in this case.
Eligible Class Members may have received a notice regarding the Godiva settlement in 2016 as the case was pending in U.S. District Court in Florida. The case was later re-filed in Cook County, Illinois.
If you submitted a valid claim in response to the 2016 Godiva settlement notice, you do not need to file a new claim in order to receive a payment in this case.
A final approval hearing on the Godiva settlement is scheduled for April 13, 2021.
Claims must be submitted electronically or postmarked by March 22, 2021. The deadline to exclude yourself or object to this settlement is also March 22, 2021.

Keyword ESTIMATED. I’ve seen someone who got $130, $162, and now $32.52, so the amounts are all over the place. Not quite sure why.

i received a second claim form earlier and it said not to submit it if i had one on file already. Yet i see on the website that the settlement is closed. have i missed the window??
You do not need to file a second claim if you filed one before.
Looks like appeal was filed just before the deadline.

Update:
A new case document is now posted on the official website. Following the hearing on May 12, 2021, Judge Cohen ruled to approve the settlement agreement on May 13, 2021. The 2 objectors (Isaacson & Helfand) were overruled. Hopefully, TCA can post an update shortly on this final ruling.

On April 13, 2021, the judge ordered a continuation of the hearing to May 12, 2021 at 11:00am, and plaintiff shall file any reply to the motion by April 23, 2021.
