Global Tel*Link has agreed to pay $8.8 million to settle a class action lawsuit alleging the company violated the Telephone Consumer Protection Act (TCPA) when it sent automated messages to 1.8 million people.

According to the class action lawsuit, Global Tel*Link operates pay phones in correctional facilities. The plaintiffs alleged that the company used an auto dialer to call those accepting a collect call from inmates in correctional facilities to ask them for billing information. The plaintiffs say that use of the auto dialer to send out unwanted calls violated the TCPA.

The Telephone Consumer Protection Act of 1991 was enacted by Congress to regulate how companies use phones and faxes to advertise. The TCPA prohibits the use of  unsolicited automated or pre-recorded telephone calls, as well as sending unsolicited text messages and faxes. The TCPA carries steep fines for violations – from $500 to $1,500 per prohibited act.

GTL denies any wrongdoing under the terms of the settlement agreement.

The company will pay Class Members approximately $60 for calls they received from GTL from Dec. 5, 2010 through April 7, 2017.

The deadline to opt out of the settlement agreement is June 15, 2018.

Who’s Eligible

Class Members include all persons using and/or subscribing to a mobile telephone number to which a “Notification Call” was placed from Dec. 5, 2010 through April 7, 2017.

Notifications calls include calls “(i) placed by or on behalf of GTL, (ii) to a number attempted in a Failed Inmate Call Attempt, (iii) using a prerecorded voice message, (iv) to explain in sum and substance that inmate calls could not be completed and/or billed, and that the called party could take certain steps to arrange for billing and/or setup a prepaid account.”

Settlement documents estimate Class Members will receive $60 each. However, the exact amount may vary depending on the total amount of claims filed.

UPDATE: On August 20, 2018, the Global Tel*Link (GTL) Robocall Class Action Settlement was granted final approval.  However, on September 19, 2018, an appeal was filed. Claims will not be paid until all appeals are exhausted.  We appreciate your ongoing patience.     With these Robocall issues; it would be more helpful if you could reference or list some of, if not all, of the phone numbers used by those companies. Since I block unisentified calls, they go to voicemail. Then, I can block them…most don’t give or leave their names!
