Western Sky Financial

The Georgia attorney general’s office has reached a settlement in an enforcement action against Western Sky Financial LLC and its related companies.

This action implicates short-term lending practices conducted by defendants Western Sky LLC, CashCall Inc., WS Funding LLC, Delbert Services Corp., J. Paul Reddam, and Martin A. Webb.

Georgia residents who took out loans issued by Western Sky may benefit from the terms of this settlement. Class Members are entitled to receive cancellation of outstanding loans and adjustments to their credit histories. Qualifying Class Members who submit a claim will also receive monetary payments.

The settlement also provides for injunctive relief barring the defendants from engaging in lending business with Georgia residents without being licensed by the state, from continuing to service or collect any loan covered by this settlement, and from continuing to offer or enter into loans at amounts and interest rates that violate Georgia law.

Who’s Eligible

Class Members include persons who took out a loan from Western Sky Financial LLC and who lived in Georgia at the time they took out that loan.

Potential Award

Varies.

The Western Sky settlement offers four types of benefits, depending on each Class Member’s particular situation.

  • Monetary Payments: Class Members are entitled to a monetary payment if they took out a loan for more than $3,000 and repaid an amount equal to or greater than their loan proceeds plus interest at 60 percent per annum, or if they took out a loan for less than $3,000 and repaid an amount equal to or greater than their loan proceeds plus interest at 10 percent per annum.
  • Loan Forgiveness: Some Georgia borrowers with outstanding loans still owned, serviced or collected by the defendants are entitled to forgiveness of those loans.
  • Credit History Adjustment: All Georgia borrowers are eligible for and will receive a credit history adjustment. The defendants have asked all applicable credit bureaus to remove any reporting made by the defendants regarding covered loans.
  • Cancellation of Loans Sold to Third Parties: Loans that the defendants sold to third parties are deemed canceled.
Proof of Purchase

Class Members seeking monetary payments must submit a Claim Form with their name, current contact information, date of birth, last four digits of their Social Security number, and signature. Class Members seeking other settlement benefits do not have to take any action to receive those benefits.

    Nothing yet. If they print the checks on the 30th, or even 29th, by the time they get mailed and cashed it will be after the first, or in the case of this month the 3rd. That will allow them to get interest for the full month. That is a lot of money for the 1.4 million dollars that they have right now. I just hope we get it all at once and not spread over 2 or 3 years.

      I thought that they had 15 million in the escrow account… where did you see they only had 1.4 million?

        The amount of the payments being made between now and 2018.

    I emailed the settlement administrator, Dahl, and asked what date the refund checks would be mailed if you filed a valid claim form by the May 15, 2017 deadline. Their response was that claim checks will be mailed by the end of June. No specific mailing date was given, just “by the end of June”.

    I called the company about the checks, told the payout department was responsible for mailing the checks, So, I hope it was not all in vain, or the lawyers are letting interest incur. IJS

    I just received in the mail some kind of “credit card” from this company last week. It hit the shredder, but I worries me that it came at all. They seem to have known too that I was approved for a mortgage also? Kind of creepy.
