GEICO agreed to pay $19.1 million as part of a class action settlement to resolve allegations it failed to pay sales tax when paying out total loss claims. 

The settlement benefits class members who were insured under California auto insurance policy through GEICO and were not paid either sales tax or regulatory fees on a claim submitted between June 27, 2015 (GEICO General), Oct. 23, 2016 (GEICO Indemnity), or June 30, 2017 (GEICO Casualty or Government Employees Insurance Company), through Aug. 27, 2020.

GEICO is an insurance company that offers automotive, homeowners, renters, motorcycle, boat and other insurance products. According to a class action lawsuit, GEICO fails to pay full total loss claims to automotive consumers.

When consumers get into a car accident, their vehicle may be declared a total loss if the damage to the vehicle eclipses the value of the car. In these cases, GEICO may pay a total loss claim for the actual cash value of the vehicle. 

However, according to plaintiffs in the case, GEICO fails to include sales tax and regulatory fees in these payments.

The GEICO class action lawsuit argues these payments violated both the company’s insurance policies and California state law. GEICO refutes these claims, arguing it complied with all applicable laws and regulations.

GEICO hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $19.1 million class action settlement. GEICO agreed to a similar settlement with Florida policyholders.

Under the terms of the GEICO settlement, class members can receive a payment for unpaid regulatory fees of $6.88 and unpaid sales tax of 7.25% plus local sales tax.

According to the settlement website, average payment amounts are calculated to be $2,051.98. However, individual payments may be higher or lower.

GEICO will also change its business practices to begin prorating regulatory fees on total loss claim payments. This will ensure future payments include fees and other expenses are included in total loss payments according to applicable regulations.

The deadline for exclusion and objection is Oct. 27, 2022. 

The final approval hearing for the GEICO settlement is scheduled for Dec. 15, 2022.

In order to receive a payment from the settlement, class members must submit a valid claim form by Nov. 11, 2022.

Who’s Eligible

The settlement benefits class members who were insured under California auto insurance policy through GEICO and were not paid either sales tax or regulatory fees on a claim submitted between June 27, 2015 (GEICO General), Oct. 23, 2016 (GEICO Indemnity), or June 30, 2017 (GEICO Casualty or Government Employees Insurance Company), through Aug. 27, 2020.

    these attorneys pulled a fast one. We all filled out the claim form, there was only one, for both amounts. we all were entitled to both amounts. but here’s the scam, the less they had to pay out, the more goes into their pockets. so although we are entitled to both they only paid us for the 6.88. thats a big amount they didn’t pay out to us. I filed a complaint with the bar, the insurance commissioner and the ag of ca. we all need to file a lawsuit against the attorney of record, all of us separately, then one naming us all in another, to cost them more to respond. i live close to their office. i can file for all of us. we need a waiver to avoid the filing cost. anyone interested my email is highmainllc@gmail. WE DO NOT HAVE TO TAKE THIS SHT. lets do this before the statue of limitations runs out. i look forward to hearing from everyone. my name is andrea degeorge drea dgorge on fb.

      Yes I did it’s weird because it doesn’t have anything to fill out as far as a claim form or anything like that like the last one it’s just says either do nothing or if you want to opt out then you have to fill out paperwork and the law suit is about purchasing car insurance through Geico nothing to do with any kind of car accidents or total loss

    I called this morning and spoke with a lady because I have not heard anything regarding the “big check (sales tax).” I submitted two claims for two cars. I already received one check for $6.88, but not a second one. Both checks for both claims were issued, however, they did not update my address correctly, so she was going to re-issue the other check that I did not receive. She did notify me that they had nothing to do with the “sales tax” aspect to the class action as the court ordered Geico to pay the consumer for the sales tax (big check) owed. She did not know any phone number for me to call, so I will be reaching out to them directly to see if I can find some well deserved answers for us all. Will keep in touch when I have more information.

    I joined this bogus Class Action Settlement within the time frame. I had a “Total Loss” claim back in 2019. I periodically called the (844) 494-0263, and the representative kept telling me that, “The monies have not been disbursed yet”. I called again 2 weeks ago, and the representative looked up my claim number and verified that Geico does indeed owe me over $2,000.00 in sales tax. I asked him when I would receive it. He told me that I needed to call Geico and tell them that they owe me $2000.00+. I told him that I thought this Class Action Lawsuit was going to pay me since they are the ones that collected the $19,100,000.00. He said they were only paying out $6.88. WHAT A FRICKEN SCAM!!!
    I proceeded to call Geico and tell them they owe me over $2,000.00 in sales tax and the rep. didn’t have any clue what I was talking about. She explained that if these lawyers sued them then they would have my $2000.00. Now I know that we all have been scammed and I am going to contact the Bar Association, Insurance Commissioner, and any other government regulator that I can to make sure that these crooks are held accountable for stealing money that should have been paid to all of us!!

      I called the lady said she sees that I received the 6.88 and that they handled that part and she said Geico is the one that’s hats handles the rest and to call them that sucks so there in control of who gets the money they can say anything just to keep from giving you the money

    USPS showed on informed delivery I had mail from the Geico lawsuit but it wasn’t delivered. Leading me to this site in search since I had a total loss during the stated timeframe. How do I update my address or find out more information?

      THIS! This is my exact question because USPS had showed me on informed delivery I was supposed to get something that never showed up. USPS said to notify the sender to resend but I can’t find an email or number or website to contact ANYONE.
