GEICO agreed to pay $19.1 million as part of a class action settlement to resolve allegations it failed to pay sales tax when paying out total loss claims. 

The settlement benefits class members who were insured under California auto insurance policy through GEICO and were not paid either sales tax or regulatory fees on a claim submitted between June 27, 2015 (GEICO General), Oct. 23, 2016 (GEICO Indemnity), or June 30, 2017 (GEICO Casualty or Government Employees Insurance Company), through Aug. 27, 2020.

GEICO is an insurance company that offers automotive, homeowners, renters, motorcycle, boat and other insurance products. According to a class action lawsuit, GEICO fails to pay full total loss claims to automotive consumers.

When consumers get into a car accident, their vehicle may be declared a total loss if the damage to the vehicle eclipses the value of the car. In these cases, GEICO may pay a total loss claim for the actual cash value of the vehicle. 

However, according to plaintiffs in the case, GEICO fails to include sales tax and regulatory fees in these payments.

The GEICO class action lawsuit argues these payments violated both the company’s insurance policies and California state law. GEICO refutes these claims, arguing it complied with all applicable laws and regulations.

GEICO hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $19.1 million class action settlement. GEICO agreed to a similar settlement with Florida policyholders.

Under the terms of the GEICO settlement, class members can receive a payment for unpaid regulatory fees of $6.88 and unpaid sales tax of 7.25% plus local sales tax.

According to the settlement website, average payment amounts are calculated to be $2,051.98. However, individual payments may be higher or lower.

GEICO will also change its business practices to begin prorating regulatory fees on total loss claim payments. This will ensure future payments include fees and other expenses are included in total loss payments according to applicable regulations.

The deadline for exclusion and objection is Oct. 27, 2022. 

The final approval hearing for the GEICO settlement is scheduled for Dec. 15, 2022.

In order to receive a payment from the settlement, class members must submit a valid claim form by Nov. 11, 2022.

Who’s Eligible

The settlement benefits class members who were insured under California auto insurance policy through GEICO and were not paid either sales tax or regulatory fees on a claim submitted between June 27, 2015 (GEICO General), Oct. 23, 2016 (GEICO Indemnity), or June 30, 2017 (GEICO Casualty or Government Employees Insurance Company), through Aug. 27, 2020.

    I was hoping to get some information after I thought about this from a year ago. I see the website is down. I supposebi will just follow this thread of comments.

      The courts told them to retire the website they said their waiting on courts to say release checks. No! They don’t have to wait on courts but they get to collect all that interest on that money sitting. Usually when they wait on courts to say release the money the judge is mad and ask them why haven’t you paid the people yet?

      They didn’t have a problem ripping us off. I left GIECO after 21 years because when they opened up to the public they charged more, and they did stuff like this class action. When they were private for the government employees only they were cheaper and they never ripped the people off

      So! I went back to triple aaa after being with GIECO 21 years
      They could of paid all of us long time ago. I’m contacting the courts tomorrow something they don’t want people to do, but this us just ridiculous, and seriously unprofessional

    I really don’t understand what is going on with this case if its been settled and the case is now closed and they still can’t give any information of when we will be paid and then I went back and looked at all of these old replies and there’s some that are saying that they got checks there’s some saying they got emails that got PayPal that got direct deposit but yet and still when I call at least one or two times a week they’re saying that they haven’t sent anybody anything so what is the truth will we get paid or was this all BS. I haven’t received any emails regarding this case except for the one to file a claim regarding this case and also receiving my claim number but that was over a year ago I haven’t heard anything since then and every time I call they just say they don’t have any information can anybody tell me is there any update of what is going on please with these gas prices and food prices I could really use the help

      So I called today and spoke to a gentleman and he told me that there not going to do any payouts anytime soon that it hasn’t reached a year since they closed the filing date of Nov 2022 and it could take 6 months or more . This really doesn’t make sense.

        Your right that doesn’t make sense I was apart of the 49er disabled class action because I’m disabled. They paid me 30days after the deadline. I got like $38,000 thousand dollars that was three years ago

        I was trying to read the court documents because customer service says their waiting for judge to tell them to release the checks. That’s boloney and they said the courts told them to take down their website(.the website is retired) it says 🤷‍♀️they told me for the last 30 days I’ll get my check in two weeks and now it’s any day. They don’t have to wait on judge to say release checks by then the judge is mad and asks why y’all haven’t paid the people yet? Interest on all that money while we suffer. I was devastated when I got the checks for two of my cars that were totaled out. I knew something was wrong. They give you enough to buy a new car. I had to add money with both my cars I couldn’t believe it. They can rip the public off then tell one story after another. I’ve already been violated twice by GIECO. I have two cars that qualify and they only see one well I wrote letters to KCC and I called GIECO I sent a copy to congresswoman Doris Matsui, Governor of California Gavin Newsom. I want get on with my life without lies. We the American people have been lied to all through the pandemic as well!
        I was with GIECO my whole state career. Gieco went public 25-30 years ago and charging me from $50 a month including towing, to $200 a month. I’ve never caused an accident or get a speeding ticket or duo’s so I went back to triple AAA and yes! Gieco called they lost a customer of 21 years and I told them y’all went public and think you can charge people anything

        Plus! Because of all this ripping the people off and raising ridiculous rates I started my own honest insurance company

        I don’t want anyone to go through what I went through with GIECO nobody!

          Oh wow I’m so sorry you have really gone through alot. I totally understand what you’re saying about Geico because the same thing happened to me when my car was totaled I barely got anything and had to add in money to get another car is ridiculous. Also when I talked to the gentleman I spoke to I gave him my claim number and he couldn’t give me any information he says he sees me on there but he couldn’t tell me how much I’m going to receive when I’m going to receive it or if I’m going to receive it nothing not one thing so I don’t understand even why they have customer service Representatives answering those phone calls if they have no answers for anyone it’s ridiculous Plus I thought the final sign off was December 15th but then they had another one on March 15th so why was there two if it was finalized in December and now look how long it’s been since December and since March and still nothing no letters in the mail no emails nothing it really makes me think that this was a bunch of BS and that nobody’s going to get anything because how in the world they don’t have any information it doesn’t make any sense I hope things get better for you if you find out any updates post a message and I’ll do the same

    I received some checks with an auto shop name but to my home address .. does not have my name anywhere on it. I called and they said to mail it back. The lady didn’t even know what it was. She was trying to look me up when I clearly said it has the name of defendant and driver only. My name is nowhere on there. I don’t have geico anymore.

    Did anyone get a check addressed to the repair shop but with your address on it. My name is not on the check so idk what to do with it.
