Amerigroup Text Spam

Follett Higher Education Group has agreed to settle a TCPA class action lawsuit alleging the company sent unwanted text messages to cell phones without prior express consent in violation of the Telephone Consumer Protection Act.

Plaintiff Lijana Shestopal brought the putative class action lawsuit against Follett Education Group last October claiming she was sent unwanted nonemergency text messages through the use of automatic telephone dialing system by Follett.

The Telephone Consumer Protection Act is a federal law that prohibits companies from placing phone calls and text messages using an automatic telephone dialing system, artificial or prerecorded voice to consumers who have not consented to receive the calls or texts.

Under the terms of the Follett text message spam settlement, Follett will pay a total of $3.5 million. This settlement amount, once approved by the Court, provides for administration expenses in the amount of $499,000 and attorneys’ fees in the amount of approximately $1,049,300.

Additionally, Shestopal as the Class Representative will be awarded an incentive fee in the amount of $3,000 for her efforts and participation in bringing the class action lawsuit.

Follett denies all of the claims and by agreeing to settle, is not admitting liability on any of the factual allegations or claims in the case.

Class Members who wish to exclude themselves or object to the terms of the settlement must do so by Jan. 20, 2017.

Who’s Eligible

The Class consists of “all individuals in the United States to whose wireless telephones Defendant, it affiliates, subsidiaries, or someone on one of their behalves, sent a nonemergency text message through the use of automatic telephone dialing system, from October 9, 2011, up to and including December 24, 2015.”

It is estimated, based on Follett’s records, that there are approximately 1.8 million Class Members.

Potential Award

Varies.

If you received an unwanted nonemergency text message from Follett Higher Education between Oct. 9, 2011 and Dec. 24, 2015 and submit a Claim Form you are entitled to a pro rata share of the settlement fund.

It is estimated that each settlement Class Member may receive the following based on the percentage of valid claims:

  • $103.39 if one percent of Class Members submit valid claims
  • $20.68 if five percent of Class Members submit valid claims
  • $10.34 if 10 percent of Class Members submit valid claims

These numbers are estimates only. The exact amount that settlement Class Members receive will depend on the percentage of valid Claim Forms submitted. That percentage is still unknown, and it could be less than one percent or more than 10 percent.

      I live in Florida and haven’t received anything . But people posted checks from out here for 107.00 so I don’t kn W how there doing it.

    i also have not yet received a check in california. the administrators are being particularly obtuse, they refuse to answer their toll free number, and sending an email to them is an object lesson in futility. it seems that these companies, who are almost all former or non practising attorneys, deliberately delay or obstruct lawful payment, even to the extent of issuing checks against non existent bank accounts, surely their is a class action looming in there somewhere.

      Email jsiprut@siprut.com It seems like noone in CA got their checks. Siprut was an attorney, representing us, class action members. I am surprised, that people don’t email law firm. Please, do your homework, and actually review website. There are phone and email for contact. I actually got claims administrator name and phone number, which is of little use, since she doesn’t answer the phone, and second number was disconnected. At least I keep on communicating with law firm, I just want to get paid.

    Has anyone in California received a check for this settlement? Mine has not arrived, and I wonder if it’s just late. Tried to call the administrator but was on hold forever, and couldn’t get thru to a live person.

    Received my check on 8/4, but am unable to cash it, bank says refer back to maker, but of course there’s no one to call. I called the merchant check line to verify the check, and they can’t even find the account number that’s listed on the check as an account that’s open with them. Not sure what to do.

        I called cause I haven’t received anything the lady said she doesn’t have any info on checks yet. She took my number and said she will call me back she from the lawyer group .
