Details: The Flonase settlement will resolve a class action lawsuit titled In re: Flonase Indirect Antitrust Litigation that claims GSK violated state laws by delaying the availability of generic versions of the nasal allergy spray. Plaintiffs alleged that GSK attempted to monopolize the market by filing sham citizen petitions with the U.S. Food and Drug Administration to delay the entry of cheaper, generic versions of Flonase into the market. As a result, consumers were injured by paying more for Flonase nasal spray than they would have paid otherwise had less expensive, generic versions of Flonase been available.

GSK denies these claims and any wrongdoing, but has agreed to a class action lawsuit settlement to resolve the allegations.

Class Members of the Flonase settlement include all consumers who purchased Flonase or generic Flonase for personal, family or household consumption in the United States and its territories from May 18, 2004 through March 31, 2009. Class Members also include those who made co-payments or other partial out-of-pocket payments through their health plans.

Class Members that submit a valid Claim Form by the deadline of August 15, 2013 will receive a cash refund from the class action settlement. The amount of this payment will be based on how many people file valid claims, among other factors detailed in the Settlement Notice.

Called today to follow-up from March 17th. I was told that someone filed an objection (between 17th -28th) and now it will take about two months. I hope that they don’t think that I believe the bullcrap!!!

I talked to an administrator today and was told that checks will be mailed out in two weeks.

  3. Big D says:

Has anyone talk to the administrator about when they think checks will be mailed out? Thanks

what I find interesting is Rust and GCG sometimes only pay a small percentage out in the settlement. Here is a quote from Sylia about the Papa John class action suit. No wonder these companies are so popular in class actions.
, You are right only 3,347 Class members getting checks for $50.00 out of a $16.5 million fund. After lawyer fees and what they paid out that leaves $13,932,650 that just disappears up in thin air.
The sued company probably quickly agree to a settlement if they know rust or garden will handle the case

The question is not about sharing settlement amounts. It should be different according to your damage or usage from products. The question is that settlement administrator discrimates people by tagging their names addresses so they reject them on any application in future meaning pure communism here.Garden city Group has done to thousands innocent victims and Rust has also done to thousands on New Balance , walborn and many other settlements. On bigger damage from medicine usage Rust rejects them with proper documents thats insane just because they have tagged these people on some 30 dollar non required receipt claim for small reason that 2 people on same address claimed something or someone sent claim of 2 relatives in same envelope eventho they are in diffrent states. They go on list to get rejected all their lives because of tagging by these administrators.Hope attorneys see this and sue these administrators.

Ryan, I wasn’t talking about myself, but sometimes I read that people get 3-4 checks, or $500 when others are getting $75. So I was just curious how some people get away with that or do the settlement administrators go after that person.

  9. ryan says:

Tom can you please explain in detail how have you been procsecuted for your inflated claim ? Why did you do it ? I have not heard anyone doing that other then you.
