ferrara wage and hour class action lawsuit settlement

Ferrara Candy Company agreed to pay $1.5 million to settle a class action lawsuit that accuses the business of discriminating against potential workers simply because they are African-American.

Plaintiffs Brian Lucas, Aronzo Davis, Torrence Vaughans and Maurice Milton filed the class action lawsuit on behalf of themselves and all others seeking employment at the Ferrara Candy Company, either directly or through two staffing agencies known as Labor Power and REM.

According to the lawsuit, the company limited or completely excluded African-American workers from being hired by Ferrara for positions of Machine Operator, Mogul Cook, Engrosser, Janitor, Quality Control Technician or Shipping Clerk.

The plaintiffs claim that they were steered away from available jobs at Ferrara by the staffing agencies who instead hired Latinos for those positions.

Ferrara, Labor Power and REM denied all allegations of wrongdoing but decided to settle the class action lawsuit to avoid the cost of further litigation.

Who’s Eligible

The Ferrara Candy class action settlement is open to all Ferrara Direct Applicant Class Members and all African-Americans who sought a work assignment through REM or through Labor Power and were otherwise eligible to work at Ferrara but were not assigned or hired to work at the company between Feb. 27, 2009 and Dec. 22, 2015.

to Jennifer did you send in your claim by certified mail?

    1. jennifer says:

      JOYCE.

NO I DIDN’T,WE DIDN’T HAVE TO, THEY GAVE TWO WEEKS TO RESPOND BACK.THEY ARE DOING WHAT THEY WANT TO DO.

      1. Dwayne says:

Yes you did they want you not to do it so it gets there to late but here how it works normal mail can take up to 21 days to deliver so you gave normal delivery 14 days which two are non business days so 12 days to deliver when certified mail is first class at 3-5 business plus you get proof when it was delivered so you can say to the claims when and where

  10. A says:

This is from Page 1 of the Notice at the bottom. “Ferrara Direct Applicant Class Member” does not include any African Americans who: (a) sought a position through REM or Labor Power during the Class Period; (b) was hired by Ferrara as a Machine Operator, Mogul Cook, Engrosser, Janitor, Quality Control Technician, or Shipping Clerk between February 27, 2011 and December 22, 2015, (c) was offered a position of Machine Operator, Mogul Cook, Engrosser, Janitor, Quality Control Technician, or Shipping Clerk between February 27, 2011 and December 22, 2015; or (d) was offered to interview for the positions of Machine Operator, Mogul Cook, Engrosser, Janitor, Quality Control Technician, or Shipping Clerk between February 27, 2011 and December 22, 2015, but declined the interview or did not report for the interview.

    1. Jane says:

So according to this if you fought a postion through any of the temp companies then you are disqualified?
