EZPawn agreed to a class action settlement to resolve claims it contacted consumers with unsolicited text message advertisements.

The settlement benefits individuals who received a text message from EZPawn regarding its goods or services since Oct. 1, 2019.

EZPawn is an online and store-based pawn shop that allows customers to buy, sell and receive loans for pawned items. The company has locations across the country with several locations in Florida.

According to a class action lawsuit against the company, EZPawn violated telemarketing laws by sending unsolicited text messages to consumers without first getting their consent. Plaintiffs in the spam text class action lawsuit claim they received numerous texts from EZPawn in violation of the Florida Telephone Solicitation Act (FTSA).

The FTSA is a state telemarketing act that provides protections similar to those provided by the federal Telephone Consumer Protection Act (TCPA). The FTSA requires businesses to express prior written consent before contacting consumers for telemarketing purposes. This covers telemarketing phone calls and text messages.

EZPawn allegedly failed to get prior express written consent as required by FTSA. As a result, the plaintiffs in the case sought damages of up to $500 per violation as allowed by the law.

EZPawn hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve these class action allegations.

Under the terms of the EZPawn settlement, class members can receive a cash payment. 

Each claimant in the case is expected to receive a settlement check worth $70. If a large number of class members participate in the claim or if the net settlement fund is smaller than expected after fees and costs are deducted, class member payment may be reduced and result in pro rata payments of less than $70.

EZPawn has agreed to adhere to telemarketing laws such as the FTSA going forward and will get express written consent before sending telemarketing text messages to consumers.

The deadline for exclusion and objection is Oct. 3, 2022. 

The final approval hearing for the EZPawn settlement is scheduled for Oct. 24, 2022.

In order to receive settlement benefits, class members must submit a valid claim form by Nov. 8, 2022.
