Equifax has agreed to pay $3 million to settle a class action lawsuit over accusations that the consumer credit reporting agency violated the Fair Credit Reporting Act.

Plaintiffs Donna Soutter, Brenda Arnold, and Joyce Ridgley filed the Equifax class action lawsuit in 2010 claiming that Equifax systemically failed to include records that Virginia General District Court judgments had been “satisfied, vacated, dismissed, or appealed in its credit reports,” thereby violating federal law.

The Equifax class action settlement offers Class Members four years of free credit monitoring or a one-time cash payment of $180.

Equifax denies the allegations and all liability, yet agreed to the terms of the settlement to avoid the burden, risk and expense of further litigation.

UPDATE: The Equifax class action settlement was granted final approval on Apr. 5, 2016.

UPDATE 2: The settlement website states that checks were mailed August 3, 2016.  Let Top Class Actions know when you receive a check in the comments section below or on our  Facebook page.

  8. Sandra says:

A so called creditor that I paid off put the same debt on my credit report 3 yrs after later and equifax fraud department told me as long as a creditor pays its membership dues the have the right to make reports on you. Mind you I provided them with proof of my payment, proof that I have not lived in the area where the creditor did business for several yrs, and proof that that creditor no longer have a valid license with the state or local government to conduct business as a collection agency. Equifax would no remove this bogus claim from my report until I sent the very same information to my state attorney general’s consumer affairs department who contacted Equifax with my very same evidence. I possess letter Equifax sent the attorney general stating they have removed the claim from my record and it will never appear again.

  9. Dwight Robbins says:

I had my state tax lien released but it reappear several times after I send the a copy of the released.

  10. Julie Mattox says:

This isnt just Virginia. They did this to be but here in Sacramento, CA. My file said I lost the case when in actuality the case was dismissed. I had to get records showing it was dismissed 3 years after it was to show to the loan officer so I could re-finance. The files were not easy to get to say the least.
