Electrolux Frigidaire

Owners of certain front-loading clothes washers made by Electrolux can now claim cash payments, rebates or reimbursements from a class action settlement.

The settlement benefits persons who acquired certain Electrolux-made washers under the Electrolux, Frigidaire, Crosley, White-Westinghouse, or Kenmore brands between Jan. 1, 2004 and Dec. 31, 2011.

This settlement resolves two Electrolux class action lawsuits filed by purchasers in Georgia and Florida. In the earlier claim from 2008, plaintiffs Robert Brown and Michael Vogler alleged their Frigidaire-branded washers, manufactured by defendant Electrolux, have a design flaw that allowed water to collect in the gasket, fostering the development of mold and mildew.

Plaintiffs Wendy and Nicholas Grasso filed the second Electrolux class action lawsuit in January 2015 over roughly the same claims. The Grassos say their washer allows mold and mildew to grow inside it, creating a nasty smell that permeates the clothes in the washer and spreads throughout their home.

The Grassos allege Electrolux refused to remedy the problem under the washer’s warranty because the warranty supposedly does not cover mold. Electrolux reportedly told them to leave the washer door open and wipe the gasket, but that still didn’t fix the problem, the couple claims.

Though Electrolux continues to deny the plaintiffs’ claims, the company agreed to a class action settlement by October 2017. Under terms of the Electrolux class action settlement, Class Members who experienced mold or mildew problems with their washers may claim either a $50 payment, a rebate on the purchase of a new Electrolux appliance, or reimbursement for costs incurred dealing with the mold and mildew problem.

Class Members can object to the settlement or exclude themselves from it by submitting a written request no later than Feb. 20, 2018.

Who’s Eligible

Class Members include persons in the U.S. and its territories who, between Jan. 1, 2004 and Dec. 31, 2011 purchased a new Class Washer, acquired one with the purchase or remodel of a home, or received one as a gift.

According to the settlement agreement, Class Washers include “any new and previously unused high-efficiency front-load washing machine manufactured by Electrolux (including 3.1, 3.5, and 4+ platforms) and sold under the Electrolux, Frigidaire, Crosley, White-Westinghouse, or Kenmore brand names.”

Potential Award

Up to $500.

Qualifying Class Members may choose to receive one of the following benefits for each Class Washer they purchased or acquired:

  • A $50 cash payment;
  • A cash rebate worth either 20 percent or five percent of the purchase price of a new Electrolux-manufactured appliance. A full list of the qualifying appliances is available here; or
  • Reimbursement for up to $500 to cover out-of-pocket expenses incurred in addressing mold and mildew issues that were “persistent” – i.e., occurred more than once. Reimbursements for garments and fabric goods damaged due to the mold and mildew issue are limited to $150 out of the total $500 limit.

Class Members who did not experience a mold or mildew issue with their Class Washer are not entitled to the $50 cash payment or the 20 percent rebate.

Proof of Purchase

Class Members claiming reimbursement for out-of-pocket expenses for service or replacement of a Class Washer or for damaged garments must include documentation of those expenses with their Claim Form.     I have had my machine repaired for not draining properly also with these units the rubber around the door is rusting which is where I believe the excess water resides causing mold mildew and the smell I was a major appliance specialist years ago and they should not rust smell I have cleaned it out with vinegar pure vinegar to reduce odor but it cannot be fixed as the rust around the door leaving the door open will not help at all

    I own a FRG front load washer and dryer since Feb, 2010. There has been black mold on the grey rubber gasket for years and my complaints to the appliance center accomplished nothing. I have always felt that it was unsanitary.

    I have a very moldy Frigidaire front load washer. I was told the same things (keep door open (which stinks) and wipe it clean). My clothes often come out stinky and we’ve resorted to stronger smelling (more expensive) detergents. I use bleach often but the mold is always present. I bought in MA about 8 years ago. We’ve learned to cope with problem because we can’t afford a new one. Do I qualify for this?

    I have a Frigidaire front loader with mold stains in the gasket. I found out it is making me sick because I am sensitive to mold and can’t clear the mycotoxins.

    I want to file for reimbursement of expenses incurred but I don’t have receipts for bleach, machine cleaners, Borax, and destroyed clothes from the last 7 years. I never called to complain to the company because all the research I did online said the company was no help so instead I tried all the self fix its I found online.

    This week we ordered replacements parts to take out all the moldy parts including the gasket/boot seal but it looks like all costs had to be incurred before the end of 2016? Is that accurate? Is there anything we can do other than a measly $50 rebate? We just ordered $160 worth of parts to replace ourselves.

    Any help is appreciated. Thank you.

    On 08/30/2017, I received an email from checkbook.io that contained a digital check for $50.00 as my settlement payment In re Whirlpool Corp. Front-Loading Washer Products Liability Litigation, United States District Court for the Northern District of Ohio, Case No. 1:08-WP-65000. It gave me 2 options to received the $50.00 – Deposit Online (fast and free) or Print Check. I chose Deposit Online. I went through the prompts to have it deposited directly to my bank account. I received another email stating I was in the process of receiving a payment of $50.00 from Washer Settlement Fund. The money would be deposited in my account on Sep 05, 2017 or earlier. I have not received the deposit to date. On 10/09/17, I emailed Checkbook Support. They sent me an email stating: “Our team just replied to your inquiry! To ask a followup question or make a comment, simply reply to this email. Your Ticket number is (——) for reference.” I emailed them back the same day and have never received a response fro them or my $50.00 deposit. Who can help me with this matter?
