Telecom Evolutions LLC and Quality Speaks LLC (together known as DSL Extreme) have agreed to a lawsuit settlement to end consumer claims the companies violated California law with false advertising by marketing their DSL Extreme TrueSTREAM internet services as “fiber optic.”
Class members include consumers who meet the following criteria:
- Purchased at least one of the four TrueSTREAM internet services packages between March 1, 2015, and July 14, 2017:
- 7I 68 kb
- 1.5 mb
- 3.0 mb
- 6.0 mb
- Maintained a standard copper-based phone line with AT&T for the duration of the time they had the TrueSTREAM service or lived in an area serviced by the ADSL1
- Lived in one of the following area codes and had a phone line with said area code: 213; 310; 323; 408; 415; 424; 442; 510; 562; 619; 626; 628; 650; 657; 661; 669; 707; 714; 747; 805; 818; 831; 858; 909; 925; 949; or 951
DSL Extreme offers DSL, dial-up, web hosting and other products and services for both consumers and businesses throughout the U.S., according to the company’s website. Its network serves tens of thousands of clients.
Per the terms of the DSL Extreme TrueSTREAM internet false advertising class action lawsuit settlement, DSL Extreme has agreed to compensate affected consumers with cash payments, and has agreed to stop referring to their TrueSTREAM internet services as fiber optic if consumers are not connected via fiber optic cable between their homes and the central DSL Extreme office.
Class members are eligible to receive cash benefits based on the TrueSTREAM services to which they subscribed:
- TrueSTREAM 768 kbps package subscribers are eligible to receive $5 per month for each month they had active service, through May 27, 2022
- TrueSTREAM 1.5 mb package subscribers are eligible to receive $8 per month for each month they had active service, through May 27, 2022
- TrueSTREAM 3.0 mb package subscribers are eligible to receive $13 per month for each month they had active service, through May 27, 2022
- TrueSTREAM 6.0 mb package subscribers are eligible to receive $13 per month for each month they had active service, through May 27, 2022
DSL Extreme has not admitted any wrongdoing to the claims made in the class action lawsuit but has agreed to settle with consumers to avoid the continued costs and risks of litigation.
The deadline to opt out of the settlement, submit a dispute or file an objection to the settlement is Dec. 21, 2022.
Class members are invited to attend a fairness hearing for the DSL Extreme fiber optic false advertising lawsuit settlement scheduled for Jan. 20, 2023.
The deadline to file a claim is Dec. 21, 2022.
