A verdict has been reached against DISH Network LLC over allegations it made telemarketing calls to phone numbers listed on the national Do Not Call Registry, in violation of the Telephone Consumer Protection Act.

If you received telemarketing calls between May 11, 2010 and Aug. 1, 2011 from a DISH retailer selling DISH subscriptions, you may be entitled to a cash payment.

Plaintiff Thomas Krakauer filed the DISH Network class action lawsuit in 2014, alleging a DISH authorized retailer illegally made telemarketing calls to him even though his phone number was listed on the national Do Not Call Registry. He claims this conduct was a violation of the Telephone Consumer Protection Act.

“Among other things, the TCPA and its accompanying regulations prohibit telemarketers from making telephone solicitations to persons who have their telephone numbers listed on the national Do Not Call Registry, a database established to allow consumers to exclude themselves from telemarketing calls unless they consent to receive the calls in a signed, written agreement,” the DISH Network class action lawsuit says.

Krakauer alleges that DISH knew many of its authorized dealers were making illegal telemarketing calls to sell DISH satellite TV subscriptions but that it failed to take steps to stop the conduct.

“Dish took the view that compliance was the dealers’ responsibility, and fell back on self-serving contractual provisions to attempt to shield itself from liability for the illegal telemarketing conducted on its behalf,” the DISH Network class action lawsuit alleges. “Under the TCPA, Dish’s efforts to avoid responsibility fail.”

According to the DISH class action lawsuit, more than 51,000 calls were made to 18,066 phone numbers that were listed on the national Do Not Call Registry during the Class Period.

The DISH Network TCPA class action lawsuit went to trial in January 2017, and a jury found that DISH Network was liable for calls placed by the retailer to phone numbers listed on the Do Not Call Registry.

Who’s Eligible

Class Members of the DISH Network TCPA lawsuit include anyone whose phone number is listed as one of the 18,066 phone numbers that were listed on the national Do Not Call Registry and received at least one telemarketing call from a DISH retailer selling DISH subscriptions.

Potential Award

Up to $1,200 per call.

The amount each Class Member will receive per call has not yet been determined. This $1,200 amount will be reduced by some percentage to pay the attorneys’ fees and costs.

    TCA whir did you see the appeal on dish network website??
    It only say ( Breaking News – On April 5, 2018, the Court entered a “Final Judgment” This means that DISH must appeal the judgment by May 6, 2018 . It does not mean DISH must now pay the money to class members. That will not happen until appeals are concluded, a process that could take 6-12 months He did not say there is a appeals Its July 13 now that’s mean the appeal time is based is that right or you see something else whir ??

      The appeals are listed on PACER. People with accounts can see up to the date case info. I’m sure that TCA is paying for an account due to the nature of their businesses so that’s why they know about the appeals. DISH has appeals in this case. Did you receive the letter telling you how much you qualified for and giving you instructions on how to appeals the attorney fees? Around 40 people who received a letter replied to it and appealed the attorney fees.

        from my letter I recvd it stated that dish had by May 6 to appeal the final approval decision,which was 30 days.so are the pacer stating the date when dish appeal was filed? this July I think appeal time has passed.so when we recvd letters requesting more info and given a date for the info to be returned in their office.so we don’t have to worry about the date,just send it when we can,and still be approved.my point is to allow people to see this crocket appeal business going on now,so wrong you all

          I was told that there are (NOT) any appeals.but they are processing claims.i received a letter from them,that is why I am making this comment to state if something you want to know,you are best to ask them yourself.i am not saying that anyone is lying on their comment,but what I am saying you can’t believe everything you read. KT tape settlement,should be an eye opening for everyone.from now to October everyone should have recvd their payment.i was told 4-6 months to process claims,which we all know it doesn’t take that long.watch that appeal game these laywers are playing now good luck

        The settlement website states that appeals are pending and claims will not be paid until appeals are resolved, which is anticipated to be mid 2019.

    What about the calls that are still being made by DISH to numbers on the DNC registry? I have been getting calls from the lately even though I am on the registry and live in an apartment bldg that does not allow DISH connections.

    I sent in my request to allow 20mfee but not 481kcost. They should have included that in fees instead being greedy. 20m is the 33% why pay anoth 481k. these firms are ripping off the Companies and the Consumers. Hopefully the judge will see and say the exact thing. So if you dont agreed with cost and fees explained in letter, you need to write your letter back

      did anyone else receive a letter from dish network settlement letting you know about the lawyers in this case is requesting to be paid more money?and I was told how much my award is going to be,but will be reduced if the lawyers request is granted.ididn’t really understand the letter to clear.i recvd the letter last month,so if someone else recvd this notice in the mail,will you please respond to this comment.

        I received the letter too. The dollar amount listed is your total payment. Like in every lawsuit, the attorney will request 33% in fees. That means that the attorney will get 33% of the payment. The letter is to inform us of this and to let us know how we can appeal if we feel like they should get less than 33%
