CSL Plasma has agreed to a $9.9 million settlement to resolve a class action lawsuit alleging it collected fingerprint data from plasma donors in violation of the Illinois Biometric Information Privacy Act (BIPA).

Anyone who scanned their finger at a CSL Plasma collection center in Illinois between Sept. 5, 2014, and Oct. 16, 2019, may be entitled to a cash payment from the CSL Plasma class action settlement.

The CSL Plasma class action lawsuit alleges CSL Plasma allegedly collected biometric fingerprint data from plasma donors in Illinois who scanned their fingers for identification at plasma collection centers without notifying them or obtaining their consent.

Collecting biometric data such as fingerprints without providing notice or obtaining consent is a violation of the Illinois Biometric Information Privacy Act.

CSL Plasma denies it violated BIPA but agreed to settle the class action lawsuit to avoid the risk and expense of ongoing litigation.

Class members who submit timely and valid claims will be entitled to a pro rata share of the settlement fund. It is estimated each claimant will receive a payment of $200 to $500, but the actual amount will depend on the total number of claims filed.

In addition to providing compensation to eligible class members, CSL has also agreed to change its practices to comply with BIPA. It will obtain written releases from Illinois plasma donors who use a finger scanner, make all disclosures as required by BIPA, maintain a publicly available biometric data retention policy, and destroy all fingerprint data within three years of donors’ last interaction with CSL Plasma.

Eligible class members should have received notice of the BIPA settlement by mail or email. Claimants who submit claims online may choose to receive payment through Venmo, Paypal, ACH Direct Deposit or paper check. 

The final approval hearing will be held Dec. 8, 2022.

The deadline for class members to exclude themselves from or object to the CSL Plasma class action settlement is Aug. 22, 2022.

Class members must submit a claim form by Nov. 3, 2022, to be eligible for a settlement payment.

    I donate in michigan and they don’t tell us either about how long they keep our fingerprints. With the changing tech no telling what they are doing. I just want my fingerprints destroyed after 6 months. I understand why they collect it but they are a cheapo company so I want my prints destroyed.
