A settlement has been reached in a class action lawsuit alleging that Nevada Property 1 LLC dba The Cosmopolitan of Las Vegas recorded telephone calls received from or placed to individuals in California, a violation of California law.
If you made a call to The Cosmopolitan or received a call from The Cosmopolitan while you were physically present in California, you may be eligible for a cash payment from the class action settlement.
Plaintiff Sasan Mirkarimi initially filed The Cosmopolitan call recording class action lawsuit in September 2012. He alleges that he had one or more telephone communications with a representative with the company while he was physically present in California.
During these calls, Mirkarimi alleges he provided confidential information such as personal financial information, his credit card number and his billing address. According to the call recording class action lawsuit, these calls were secretly recorded without Mirkarimi’s knowledge or consent.
The Cosmopolitan denies the allegations but agreed to settle the call recording class action lawsuit to avoid the expense and risk associated with ongoing litigation.
Under the terms of the proposed call recording settlement, The Cosmopolitan will pay a total of $14.5 million to resolve the litigation. In addition, for a period of three years, The Cosmopolitan will not record a telephone call with any person using a telephone number with a California area code without first informing them that the call may be recorded.
The Cosmopolitan call recording class action settlement was preliminarily approved on Aug. 24, 2015.
Who’s Eligible
Class Members of The Cosmopolitan call recording settlement include anyone who, while physically present in the state of California, either:
- Placed a telephone call to The Cosmopolitan between July 12, 2011 and Aug. 3, 2012 that was recorded by The Cosmopolitan; or
- Received a telephone call from The Cosmopolitan between July 12, 2011 and Feb. 20, 2015 that was recorded by The Cosmopolitan.
Potential Award
The amount each claimant will receive depends on the Net Settlement Amount and the total number of Class Members who file valid claims.
It is estimated that the Net Settlement Amount will be $10 million, and therefore if 20,000 Class Members file claims, they would receive $500 each. If 40,000 Class Members file claims, they would receive $250 each.
The actual payment could be higher or lower than these estimated amounts.

Nothing in temecula as well.
No check for Inland Empire again! I called several times to verify my info!
Did they have your information in their system?
Check came in Long Beach! Could have sworn I gave my SS, but it was still for $502. Still grateful.
Check it irvine today. The bottom of the envelope has a processing barcode but no time stamp to prove when it was mailed
Awesome! I’m in Irvine too. I could’ve crawled to their office & picked it up faster than it’s taking to get it in the mail. Hope mine comes today too!
Check came today….$773.63 before withholding.
what city?
Received a wedding invitation from a relative today that was sent out Tuesday from Santa Ana, CA. I live in Fresno. Probably got the invitation faster because Santa Ana is closer to Fresno than Irvine by a few miles. My thinking by what I have read on this site they lied and sent the mail out Wednesday to California residents knowing a majority of the members live here (the others using a CA area code) and dating everything 4/29/16. Might be the money stays in the bank longer. My bank starts a new day at 4:30 PM (mon-fri). Once the checks get to us I think we will deplete the approximate 10 million very fast and if individuals cash their checks late in the afternoon Friday thru Monday and if their banks are like mine (even check cashing stores) it wont even be taken out of the administrators account until Monday or Tuesday. Again this is just my thoughts. Thanks
Santa Ana & Irvine are so close to eachother that the airport is called…SNA. All mail goes through the same processing facility (Anaheim.) Bottom line, they’re playing games.
Thank you Brian, I hope you are right!
There is no need to request a replacement check because we will get them. The issue at hand is that they lied about when they were mailed. That is why no one has received a check in the mail. People on the facebook are quick to post a picture of their checks when they are the first to get them. If it were one out of 100 people who did not get a check then I would say that the one check is lost. They paid out a little over 12,000 checks so there is no way that they are all lost in the mail. Why do you think that there is a class member who was told that she had to wait five days to pick up a check that was ready on Friday? That is because the checks were not sent until then. I bet people closer to OC will get them tomorrow and everyone else will get them on Saturday.
No check in the Inland Empire. CPT said it left their hands on Friday, April 29. I cannot even request for a replacement check until 30 days after they mailed it, and even then it will take 6-8 weeks to receive…
No check again in Fresno
