Cosmopolitan class action settlementTop Class Actions readers are starting to receive checks in the mail from a class action settlement stemming over allegations that The Cosmopolitan of Las Vegas recorded phone conversations without the knowledge of future guests in violation of California law.

According to reader comments and posts on the Top Class Actions Facebook page, Class Members who submitted timely and valid claims for The Cosmopolitan settlement began receiving checks worth as much as $773.63 on May 6, 2016.

The Cosmopolitan class action settlement resolves allegations that the hotel violated California state law by recording the phone calls of customers that either placed or received a call from the hotel.

According to the plaintiff, The Cosmopolitan would secretly record conversations between hotel representatives and guests without knowledge or consent of the recipient.

The class action alleged that during these recorded phone calls, hotel customers would provide personal information including credit card numbers and billing addresses, not knowing that the conversation was being recorded.

While the hotel agreed to pay $14.5 million to resolve the accusations, The Cosmopolitan did not admit to any wrongdoings but rather agreed to the settlement to avoid the cost of further litigation.

Class Members of The Cosmopolitan settlement include California residents who placed a phone call to the hotel within the state between July 12, 2011 and Aug. 3, 2012 that was recorded by The Cosmopolitan; or those who received a telephone call from The Cosmopolitan that was recorded between July 12, 2011 and Feb. 20, 2015.

The deadline to file a claim for the Cosmopolitan call recording class action settlement passed on Nov. 23, 2015.
