Cosmopolitan class action settlement

A settlement has been reached in a class action lawsuit alleging that Nevada Property 1 LLC dba The Cosmopolitan of Las Vegas recorded telephone calls received from or placed to individuals in California, a violation of California law.

If you made a call to The Cosmopolitan or received a call from The Cosmopolitan while you were physically present in California, you may be eligible for a cash payment from the class action settlement.

Plaintiff Sasan Mirkarimi initially filed The Cosmopolitan call recording class action lawsuit in September 2012. He alleges that he had one or more telephone communications with a representative with the company while he was physically present in California.

During these calls, Mirkarimi alleges he provided confidential information such as personal financial information, his credit card number and his billing address. According to the call recording class action lawsuit, these calls were secretly recorded without Mirkarimi’s knowledge or consent.

The Cosmopolitan denies the allegations but agreed to settle the call recording class action lawsuit to avoid the expense and risk associated with ongoing litigation.

Under the terms of the proposed call recording settlement, The Cosmopolitan will pay a total of $14.5 million to resolve the litigation. In addition, for a period of three years, The Cosmopolitan will not record a telephone call with any person using a telephone number with a California area code without first informing them that the call may be recorded.

The Cosmopolitan call recording class action settlement was preliminarily approved on Aug. 24, 2015.

Who’s Eligible

Class Members of The Cosmopolitan call recording settlement include anyone who, while physically present in the state of California, either:

  • Placed a telephone call to The Cosmopolitan between July 12, 2011 and Aug. 3, 2012 that was recorded by The Cosmopolitan; or
  • Received a telephone call from The Cosmopolitan between July 12, 2011 and Feb. 20, 2015 that was recorded by The Cosmopolitan.
Potential Award

The amount each claimant will receive depends on the Net Settlement Amount and the total number of Class Members who file valid claims.

It is estimated that the Net Settlement Amount will be $10 million, and therefore if 20,000 Class Members file claims, they would receive $500 each. If 40,000 Class Members file claims, they would receive $250 each.

The actual payment could be higher or lower than these estimated amounts.

  1. Greg says:

No check here in Playa Vista. They did lie because the Vans frozen food settlement was mailed from Pennsylvania on Friday and the checks started arriving to the Los Angeles area yesterday. I will also be contacting the attorneys if the checks do not have a date of 4/29/16 on them. It is not about needing the money because I dont, but CPT group is being paid for a service that they are clearly incapable of providing. The attorneys should know what they are doing so that they do not use them again. Their first lie was that they did not receive the money from Nevada Property 1, LLC and that is why the date was pushed back to last week.

  2. KR says:

The mail came here in Long Beach, and there was no check. If it was mailed Friday, even Saturday, it would be here by now. They lied.

  3. Patrick says:

Ok I am Stephen/Patrick. I was the one who didn’t get the check. I keep auto filling my work partners name lol. If I don’t get a check tomorrow then I am calling the class attorney’s. I work from home and received mail on Monday that left the New York City office on Friday morning. That’s why I don’t believe that they mailed the checks on Friday.

  4. KR says:

Maybe we are calling different numbers? I called 1 888 219 4645. I waited until all of the automated recording was done, and then a person came on the line.

  5. James says:

Hello I just called also and asked if I can pick up my check and she told me that I need to call back around 3pm or tomorrow. I asked how can I find out if it was mailed and she told me that I would need to talk to the claim manager and that would take 2-3 days. I feel like these people are definitely hiding something from us. They are clearly lying to us that the checks were mailed out on Friday. I don’t know if they are holding on to the checks to gain more interest on them or what. I’m starting to think what kind of action I can take with this company.

    1. KR says:

James- Did she verify your address? Did you get a postcard approving your claim? I don’t understand why some of us are getting 1 story and some are getting another.

      1. James says:

I verified my address multiple times and I received a post card months ago. If they mailed the checks out they should have record of it and when we call to check status we shouldn’t have to wait 2-3 days to talk to the claim manager. Something doesn’t add up here???

  6. KR says:

I just called. The lady who answered checked my name and address. She said that checks were mailed late Friday, so its just a matter of waiting for the post office to deliver them. She said that she doesn’t have the amount for the checks, but she would have that number tomorrow if I want to call back then, if I haven’t gotten my check by then.

  7. christine says:

I’m starting to think they didn’t even mail any checks

  8. Stephen says:

My mail was just delivered in irvine and I didn’t get a check

  9. KR says:

Does anyone know the amount of valid claims or the amount of the checks yet?

  10. Sherene says:

I called today too and was told by Alexis that the checks went out on Friday.
