A class action settlement has been reached ending allegations that Consumers County Mutual Insurance failed to pay PIP claims properly.
Class Members include those who were insured through Consumers County Mutual Insurance and made a claim for Personal Injury Protection (PIP) that was not paid because the medical bill associated with the claim was paid by a third party insurer between March 14, 2012 and March 13, 2019.
Lead plaintiffs alleged that those insured by Consumers Country Mutual Insurance were denied some or all of their PIP claims when a third party insurer paid the medical bills related to the claim.
According to the Consumers County Mutual Insurance PIP class action lawsuit, failure to properly pay these claims is a violation of the insurance policy the plaintiffs signed up for.
Consumers County Mutual Insurance Company, based in Dallas, underwrites a number of auto insurance companies. The plaintiffs said that the insurance company violated Texas law by failing to pay PIP claims.
The company agreed to settle the Consumers County Mutual Insurance PIP class action lawsuit. Under the terms of the settlement, Class Members can claim up to 95 percent of the PIP claims not paid because the medical claim was paid by a third party insurer.
To benefit from this settlement, Class Members must print and mail a Claim Form and provide the last four digits of their Social Security number. The form also requests additional information to help locate the PIP claim.
Class Members who wish to object to or opt out of the Consumer County Mutual Insurance PIP class action settlement must do so by July 1, 2019.
Who’s Eligible
Class Members include “Every Person who, from March 14, 2012 to March 13, 2019, was insured under a Policy underwritten by the Defendant, Consumers County Mutual Insurance Company, or any of its Affiliates, and who filed a claim for Personal Injury Protection (‘PIP’) benefits where the claim or a portion thereof was not paid solely because the medical bill(s) were paid by a third party insurer.”

Class Members will receive 95 percent of what was left unpaid by Consumers County Mutual Insurance Company or its affiliates. The actual amount will vary depending on the amount of the PIP claim denied by the defendant.

Nationwide has failed to pay my pip on 2 wrecked totaled cars. Stating they paid medical bills and i am still receiving total bills with nothing showing paid any amount at all.
