A $3.025 million settlement has been reached to resolve claims relating to the 2018 ComplyRight data breach that compromised consumer information.

The settlement will benefit individuals whose personal information was maintained on ComplyRight’s website during the data breach that occurred at least between April 20, 2018 and May 22, 2018.

ComplyRight offers employment and labor law compliance services to employers. According to the settlement website, Class Members were sent a letter by ComplyRight on July 13, 2018 informing them of the data breach.

The letter reportedly informed Class Members that their name, address, telephone number, email address, and social security number may have been compromised in the data breach. The letter also included an offer for a free year of credit monitoring and identity theft protection services.

However, this was reportedly not enough. In August 2018, several plaintiffs filed a data breach class action lawsuit against ComplyRight. They claimed that the company failed to protect their information and did not warn them immediately after the data breach was detected. The ComplyRight class action was consolidated and amended in September 2018 to include more plaintiffs.

After several mediation sessions, the plaintiffs reached a settlement agreement with ComplyRight in April 2019. ComplyRight agreed to pay $3.025 million to establish a settlement fund and resolve the claims. ComplyRight has not admitted any wrongdoing by settling the case against them. Instead, the settlement provides a resolution for all parties while avoiding the costs and risks of continued litigation.

There are three compensation options available under the settlement. Class Members can choose from a protection plan, a cash payment estimated to be $50, or up to $200 in expense reimbursement. In order to receive any of these benefits, Class Members need to file a valid claim form by Dec. 6, 2019. Proof may be required for expense reimbursement.

The deadline to opt out of or object to the settlement is Sept. 16, 2019. The ComplyRight class action settlement’s final approval hearing is scheduled for Oct. 7, 2019.

Who’s Eligible

Individuals whose personal information was maintained on ComplyRight’s website during the data breach that occurred at least between Apr. 20, 2018 and May 22, 2018. Class Members were sent a letter by ComplyRight on July 13, 2018 informing them of the data breach.

Potential Award

Three compensation options to choose from:

  1. A two year protection plan through MyIDCare that includes credit monitoring, credit monitoring protection, dark web monitoring, fully managed recovery, $1,000,0000 insurance coverage for reimbursement of data breach-related losses, lost wallet assistance, and 24-hour customer service.   2. A cash payment of around $50. Payment may be higher or lower depending on the number of claims filed and the net settlement fund after costs and fees are paid.
  3. Up to $200 in expense reimbursement. Documented time will be compensated at $15 an hour for up to 3 hours ($45 total) and other documented expenses (police reports, late charges, overdraft fees, etc.) will be reimbursed.
