ComEd TCPA class action settlement

Commonwealth Edison Company has agreed to settle a class action lawsuit alleging it sent unsolicited text messages to cellular telephones using an automatic telephone dialing system in violation of the Telephone Consumer Protection Act (TCPA). If you received a text message from ComEd on your cell phone stating that you were subscribed to outage alerts, you may be entitled to payment from the class action settlement.

Plaintiff Michael Grant filed the class action lawsuit against Commonwealth Edison after he received an outage alert text message that stated, “You are now subscribed to ComEd outage alerts. Up to 21 msg/mo. Visit ComEd.com/text for details. T&C:agent511/tandc. STOP to unsubscribe.” The ComEd class action lawsuit alleges that ComEd violated the TCPA because consumers did not agree to receive the text messages and because the text messages were not sent about an actual emergency.

ComEd does not admit liability but has agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty of ongoing litigation. Under the terms of the class action settlement, Commonwealth Edison will create a $4.95 million settlement fund that will be used to pay cash benefits to eligible Class Members.

Who’s Eligible

Class Members of the ComEd TCPA settlement include all individuals in the United States who received an outage alert enrollment text message from ComEd without their consent.

The outage alert text message stated: “You are now subscribed to ComEd outage alerts. Up to 21 msg/mo. Visit ComEd.com/text for details. T&C:agent511/tandc. STOP to unsubscribe.”

Potential Award

It is estimated that Class Members who file valid and timely claims will receive a cash payment of $50 from the TCPA settlement, though the actual amount may be more or less depending on the total number of claims filed.

UPDATE: Readers of Top Class Actions have reported that they began receiving checks from the ComEd TCPA settlement on Dec. 21, 2015. Congratulations to everyone who filed a valid claim and got PAID!

      have anyone recvd reissued check from these crocks yet?these people are on their way to prison,even if they get by with this,they are going to try something else,evenually they will get caught. (COMPUTERS ONLY PUT OUT WHAT YOU PUT IN)they was aware of what they was doing.wish this can be reported.

    I also recieved mine and I am from Illinois, rcv 12/23/15. I havent deposited it yet because I dont want it to be a fraudulent check. Has anybody’s check been deposited and cleared?

    I received several checks with someone else name on it. I did send them back.

    My check had the wrong name too. I spoke with the administrator. They are aware of the situation. They have identified those that have the issue and are sending out new checks. Yes!!!
