ComEd TCPA class action settlementChecks have reportedly been mailed to consumers who filed claims for a class action settlement over allegations Commonwealth Edison Company (ComEd) sent unsolicited text messages to cellular telephones in violation of the Telephone Consumer Protection Act (TCPA).

One reader of Top Class Actions has reported receiving a check worth $176.08 from the ComEd TCPA class action settlement.

Plaintiff Michael Grant filed the class action lawsuit against Commonwealth Edison after he received an outage alert text message that stated: “You are now subscribed to ComEd outage alerts. Up to 21 msg/mo. Visit ComEd.com/text for details. T&Cagent511/tandc. Stop to unsubscribe.”

According to the TCPA class action lawsuit, ComEd violated the TCPA because consumers did not agree to receive the outage alert text messages and because the text messages were not sent about an actual emergency.

ComEd denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The company agreed to create a $4.95 million settlement fund that would be used to compensate eligible Class Members.

Class Members of the ComEd TCPA settlement include all individuals in the United States who received an outage alert enrollment text message from ComEd without their consent. It was estimated that Class Members who filed claims for the ComEd class action settlement would receive a cash payment of $50, though the actual amount could be higher or lower depending on the total number of claims filed.

The deadline to file a claim for the ComEd TCPA class action settlement passed on Oct. 26, 2015.

    I did receive a check for 176.08. However dummy me I lost it…I have contacted them 2x to get a reissue….and no one has bothered to call or email me back. Is there a number to call them directly so I dont get their tollfree just information line? Anyone know? Thanks!

I have it on good authority the justice dept is checking out all these false claims, so don’t be surprised if a lot of you don’t have a job next year working for the federal Government at 25 cents an hour!! Its called Fraud folks, plain and simple. These few dollars isn’t going to do you much good in the federal Pen. GET A REAL JOB!!!!
