Cigna and American Specialty Health have agreed to pay $8.25 million to resolve claims that they charged improper administrative fees.

The settlement will benefit Cigna plan members whose plan benefits and/or cost share under a plan were determined based on American Specialty Health’s charges to Cigna for the following types of services: chiropractic, acupuncture, massage therapy, naturopathy, physical therapy, or occupational therapy.

In December 2012, plaintiff Carol Lietz first filed claims against Cigna Corporation and American Specialty Health Group Inc., the company which provides Cigna with a network of healthcare providers and processing of claims.

Lietz claimed that Cigna forced its plan members to pay administrative fees to American Specialty Health by secretly charging the costs as medical expenses.

Eventually, Leitz’s claims against Cigna and American Specialty Health were consolidated into a larger class action lawsuit with plaintiffs Kathleen Kilroy, Jianliang Zhu, and Joyce Allen. Together, these plaintiffs brought claims under the Employee Retirement Income Security Act (ERISA).

The consolidated class action lawsuit was eventually settled by Cigna and American Specialty Health. The companies do not admit wrongdoing by settling the claims against them. Instead, the settlement will allow for the resolution of claims without the risks and costs of continued litigation.

At this time, there is not an estimate for how much each Class Member’s payment will be. The amount to be distributed to Class Members will depend on attorneys’ fees, notice and administration costs, litigation expenses, and service awards.

Of this amount, Class Members will receive a pro rata payment based on the co-insurance or deductible amount paid for approved services.

Although there isn’t a solid estimate amount available for Class Member payments, the settlement notice states that payments are estimated to “fully compensate Settlement Class members who made out-of-pocket payments towards administrative fees.”

Class Members are not required to file a claim to participate in the settlement. By doing nothing, Class Members will automatically benefit.

The deadline for exclusion and objection is July 10, 2019. The final approval hearing for the settlement is currently scheduled for Aug. 9, 2019.

  1. Bob B says:

I received a check for $19.32 on 4/12/20. I had some physical therapy 3 years ago and stopped going as the charges I was quoted were paid at a higher amount which effected our out of pocket part. Knew nothing of this until I looked up the lawsuit.

  2. Cheryl Davidson says:

I received a check in the amount of $22.91 from the CIGNA Admin Fee class action suit.

  4. Laura says:

Got a check today for $33.60

Had a similar problem previously with ASH chiropractor in 2016 when I had FL Blue Cross Blue Shield.

At least this time I got something back.

  5. J Toler says:

Received a check today for $0.70 – what a joke! I got acupuncture 3x’s a week for a few years and then 2x’s a week up until 2018. Cigna deducted an Admin. Fee on every visit and I end up with $0.70. Cigna is knee-deep in Class Action Lawsuits, glad I no longer use them for insurance.

  6. Brian Flynn says:

I just had two checks show up today, one for me and one for my wife. Both were for around $20 and at first I thought they were a scam, but after researching things, it doesn’t look to be a scam. Glad I found this site.

  7. David Thames says:

I received a check today for $6.60. As usual, looks like the the lawyers were the big winners!

I received a check for 24.75. Didn’t know what it was for wasn’t expecting it came to this website to find out about it. It looks like my check is a lot more than other people in this post.

  9. Amanda says:

My husband and I each got checks today for .44 cents each.

  10. Saguan says:

    Anyone received any checks?

    1. Craig says:

I received a check today for $2.42. Does anyone know how much the attorneys were paid?

      1. KA says:

I got $1.65 lol. but i probably only paid $200 in administration fees.
As far as the lawyers- the final decision says:
“For the reasons stated herein, this Court grants final approval of the proposed class action settlement, awards Class Counsel reasonable attorneys’ fees in the amount of $2,750,000.00 and the reimbursement of expenses in the amount of $133,211.80, and awards the sum of $10,000.00 to each of the Class Representatives, Carol Lietz, Kathleen Kilroy, Jianliang Zhu, and Joyce Allen. ”

So yeah, they made out pretty well.

    2. Brenda L High says:

I received the notification but never received any compensation. Should I continue to look for a check?
