CenterState Bank, now known as SouthState Bank, agreed to a $2.65 million class action lawsuit settlement to resolve claims that it charged illegal overdraft fees and nonsufficient funds (NSF) fees.

The settlement benefits CenterState Bank customers who had a checking account with the bank and were charged certain overdraft fees on debit transactions between April 6, 2015, and May 31, 2020, or NSF and overdraft fees on ACH debits or checks between Aug. 18, 2015, and Aug. 21, 2020.

Plaintiffs in the class action lawsuit claim CenterState violated its account agreements by charging illegal overdraft and NSF fees. These fees were allegedly justified with deceptive business practices that harmed consumers.

CenterState Bank, now SouthState Bank, is a financial institution with over 240 branches and ATMs in Alabama, Florida, Georgia, North Carolina, South Carolina and Virginia. 

CenterState hasn’t admitted any wrongdoing but agreed to a $2.65 million settlement to resolve the bank fees class action lawsuit.

Under the settlement terms, class members can receive a pro rata share of the net settlement fund based on the amount they were charged in illegal bank fees. Class members can receive a cash payment, account credit or forgiveness of uncollected fees, depending on their situation. 

The deadline for exclusion and objection is Oct. 23, 2023.

The final approval hearing for the settlement is scheduled for Nov. 30, 2023. 

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment.
