Nissan class action lawsuit

Nissan North America Inc. and Nissan Motor Co. Ltd. have agreed to settle a class action lawsuit alleging some of its vehicles were affected by a timing chain system defect.

If you purchased or leased one of the following vehicles in the state of California or Washington, you may be entitled to a partial refund if you paid to repair the engine timing chains in the vehicle:

  • 2004-2006 Nissan Altima (VQ35 engine)
  • 2004-2008 Nissan Maxima
  • 2004-2009 Nissan Quest
  • 2005-2007 Nissan Frontier (VQ40 engine)
  • 2005-2007 Nissan Pathfinder
  • 2005-2007 Nissan Xterra

If your vehicle engine is making a high frequency whining or buzzing noise that increases in frequency with engine speed, it may be an indication that your timing chain system needs to be repaired, and you may be entitled to a partial refund of the repair costs.The plaintiffs allege the Nissan vehicles named above have a timing chain defect that causes the timing chain tensioning system to be prone to premature failure. According to the Nissan class action lawsuit, the Nissan defendants were aware of the timing chain defect since at least 2003 but failed to disclose the alleged defect to consumers.The Nissan class action lawsuit says that Nissan actually sought to conceal the timing chain defect from consumers and issued Technical Service Bulletins to repair facilities informing them that it was necessary to replace certain elements of the timing chain tensioning system but did not inform consumers about the alleged timing chain defect or provide a permanent solution to address the defect.“Instead, Nissan concealed its knowledge of the issues and failed to develop a permanent solution so that the warranty period on the Subject Nissan Vehicles would expire before owners become aware of the problem,” the second amended Nissan class action lawsuit states.“Through this practice, Nissan unlawfully transfers the cost of replacement from itself to the owners of the Subject Nissan Vehicles.”The Nissan class action lawsuit was granted Class certification in April 2016.Nissan denies any wrongdoing but agreed to settle the timing chain tensioning system class action lawsuit to avoid the burden and expense of ongoing litigation.The Nissan timing chain class action settlement was preliminarily approved on Feb. 1, 2018.Class Members who would like to opt out of or object to the Nissan timing chain settlement must do so no later than June 11, 2018.

Who’s Eligible

Class Members of the Nissan timing chain settlement include anyone who purchased or leased one of the following vehicles in California or Washington:

  • 2004-2006 Nissan Altima (VQ35 engine)
  • 2004-2008 Nissan Maxima
  • 2004-2009 Nissan Quest
  • 2005-2007 Nissan Frontier (VQ40 engine)
  • 2005-2007 Nissan Pathfinder
  • 2005-2007 Nissan Xterra
Potential Award

Class Members who submit timely and valid Claim Forms are entitled to either partial reimbursement of their repairs or a voucher towards the purchase of a new Nissan vehicle, if they paid to diagnose, repair and/or replace the primary or secondary timing chain systems or components in the vehicle after the factory warranty expired but before the vehicle accumulated more than 120,000 miles.

The actual amount each Class Member is entitled to receive depends on several factors, including the warranty coverage, mileage on the vehicle, and the date the repairs were made.

Claimants may be eligible to receive payments of $500 to $1,500 toward the purchase of a new Nissan vehicle or a reimbursement of between 20 percent and 80 percent of the first $900 paid for repairs.

Proof of Purchase

Class Members may be asked to provide the Unique ID on the Claim Form that was mailed to them as well as certain documentation showing the repair was to the primary or secondary timing chain system or components and documentation of the amount the Class Member paid for the repair.

NOTE: If the repair was made after April 2, 2018, the repair order must be from an authorized Nissan dealer and must show that the repair was necessary because of a broken slack guide retention clip, an unseated slack guide, or worn secondary tensioner shoes.

Claim Form Deadline

If repairs were made prior to April 2, 2018, the Claim Form deadline is July 2, 2018. If repairs were made after April 2, 2018, the Claim Form deadline is 90 days after the repair date.

    YES , PLEASE I AM INQUIRING AS TTO MY SETTLEMENT IN THIS MATTER. I HAVE AS OF RECENTLY LOST MY HUSBAND , I HAVE BEEN EXTREMELY BUSY TRYING TO REBUILD MY LIFE AND MY CHILDRENS LIVES. I ONLY AS IF RECENT WAS NOTIFIED TO INQUIRE ON THIS MATTER. I WAS DRIVING UP TGE HIGHWAY AT 75_80 , M.P.H. WHENEVER MY TIMING CHAIN WENT OUT. HOW WE MADE IT ONLY GOD KNOWS. THAT NOT ANY OTHERS WERE HARMED BEHIND US , GOD ONLY KNOWS. I HAD BOUGHT MY TRUCK IN DECEMBER OF 2019 , WHEN MY TIM IIJ NG CHAIN WE WENT OUT I HAD ONLY HAD IT , FULL COVERAGE INSURANCE THROUGH YHE COMPANY WITH WHICH I BOUGHT MY NISSAN PATHFINDER FROM.     I’m not even going to try bought truck off friend I’m third owner don’t know if truck was originally from California truck wouldn’t start running fine when I parked it at work ending up one of the timing chains went ruined motor had to replace paperwork was sent to my friend.hearing all of the negative comments what’s the point what’s done is done

    If you want to check on the status of your claim, I listed their contact information. When he responded to me he stated my claim was incomplete because I did not provide supporting documentation when in fact I did. So hopefully you all have better luck than me.

    I own a 2007 Xterra S model. About to do the 2nd timing chain change for the same issue with the guides/tensioners wearing out. Since I bought it in Florida I’m SOL ! But I see that no one has gotten reimbursed, even those in the states w Class Action. WTF Nissan, I used to swear by your product. At least pay for the repair, at least. i’ll keep the car.

    Does anyone know if this settlement holds valid on claims in the future, I have a 05 Xterra and have not experience this issue yet thankfully. If it does what should my next move be?
    The repair cost everyone is mentioning is beyond what I can bear to pay.

    2012 Nissan Murano just blew an engine with 64k miles.
    They refuse to fix it and it’s still under warranty.
    Said timing chain was part of the issue.

    Well how crappy is this. I cant file a claim for the same issue with my maxima because it was not purchased it Washington or California. How fair is this ?????????????? I am out of so much money hand have to get the car fixed because it is beautiful and fully loaded.

      THERE’S a firm that is handeling for the country.
      I just had to pay $3,200 for a timing chain repair on my 04 Quest. What the dealership told me when I told him I knew about this issue is that well your car is old etc etc. But as this article States Nissan has known about this issue since 2003. Before my car was even made. And I really don’t feel like settling for 20% of $900. When I spoke to the law firm which I’m trying to find their name again they told me it would be best that I opt out and try to recoup on my own because there’s no way I’m going to get even close to what I had to pay. I’m going to try to start a group to pull people in and have these people contact Nissan Corporation and let them know that this is something they’re not going to get away with. They left a car is age out which would give them the excuse, your car is old.

    What money, I filed a claim in Oct, 2018, along with all the necessary prof of repair. That being a detailed cost breakdown, labor and vehicle millage, all within the framework, required to receive a settlement award. I also received a code # verifying I had met those requirements from the lawsuit administrators. So, wheres the money? Clearly that a reasonable question to ask, especially in light of the fact that the courts, settled the issue in July, of 2018. I also have tried over and over to learn if any monies have been paid out? So far, not one claimant, that I have heard of has done so. Perhaps we should refer the matter to the superior court judge who handed down the decision? At least get an answer.
