DB Security class action settlement

Benefits from a $30 million class action arbitration settlement are now available for security professionals who are current or former employees of Universal Protection Service.

Current and former employees can qualify for payment if they worked as a security guard or in a similar position between Feb. 26, 2011 and Nov. 22, 2017.

Claimant Robert Stone brought this action in private arbitration, raising claims under federal and California employment law.

Stone alleges respondent Universal Protection Service LP failed to pay minimum wage and overtime rates for all qualifying hours worked. He further alleges Universal Protection Service violated requirements governing meal breaks, rest breaks and waiting times, and that the company failed to reimburse employees for necessary business expenses.

Stone sought recovery of unpaid wages, injunctive relief, and penalties under the California Private Attorneys General Act.

Universal Protection Service continues to deny Stone’s claims but agreed to the settlement in the interest of avoiding the cost of further litigation.

The settlement also resolves similar claims raised elsewhere by plaintiffs Brittany Cole, Andres Medina and Melonie Goodrum. All three of those plaintiffs and Stone serve as class representatives in this arbitration.

Under terms of the settlement, Universal Protection Service will pay a maximum $30 million. This amount will cover a $15,000 award to each of the named class representatives, class counsel’s attorney fees and costs, the costs of administering the settlement, and a payment to the California Labor & Workforce Development Agency.

The remaining settlement funds will be distributed among qualifying Class Members who submit valid and timely claims, according to the number of weeks they worked for Universal Protection Service during the relevant period.

Universal Protection Service says that, as required by law, it will not retaliate against any employees for participating in this settlement.

Class Members can exclude themselves from the settlement or object to its terms by submitting a written request no later than Feb. 14, 2018.

Who’s Eligible

The Class covers any person employed in California by Universal Protection Service LP or any of its successors as a non-exempt security professional – for example, security guards, or jobs with similar titles and duties – at any time from Feb. 26, 2011 through Nov. 22, 2017.

Potential Award

Individual settlement payments will be based on the number of work weeks the Class Member worked during the class period, which runs from Feb. 26, 2011 to Nov. 22, 2017.

Payments will be adjusted for Class Members who already settled a portion of their claims through another settlement referred to as the Davis/Mitchell-Straub settlement or who opted out of that settlement.

The settlement website does not offer an estimate of individual payment amounts but provides this formula: “Individual Settlement Payment = Individual Work Weeks ÷ Class Work Weeks × Net Settlement Amount.”

Proof of Purchase

Class Members may submit a claim online using the Claim ID found in their mailed settlement notice. Claim Forms may also be submitted via mail.

Class Members may need to submit a filled-out IRS Form W-9, if applicable.

    Lmao!! I don’t think they’ll send the $$$$ but I’ll keep waiting!!

  2. Irwin Soerink says:

Well it’s almost August don’t expect any checks until end of September. They have been telling me a couple of more months since March. I strongly believe that the law firm doesn’t know and that’s why they just blow bull shit up your ass, every time someone asks. If I ever file a class action suit, which Wii be soon, remind me never to use any of these law firms.

  3. Darlene Dixon says:

I spoke with a rep, he said we’re just waiting for the judge to sign off on the case. Then last month he said it will take 3 more months now to receive the checks

  4. Tagar Edgardo Téllez says:

Bueno yo como todos ustedes en espera de recibir noticias de la entrega del cheque, ahora solo queda esperar a ver que pasa.

  5. Drew says:

It’s July 14th now. Anyone get a check or new update?

    1. RUEBEN E VEGA says:

Nothing no news!! I wonder how Roger Stone is feeling right now!! Wish he would comment!!

      1. Brittany C. says:

I am a class representative, I actually started the class action. I’m completely in the dark! Not even my attorneys tell me anything. I wish we knew something but we don’t. Good luck!

        1. Darlene Dixon says:

I spoke with a red he said we’re just waiting for the judge to sign off on the case. Then last month he said it will take 3 more months now to receive the checks.

        2. RUEBEN E VEGA says:

That sucks!! Some people said they might of put $$$$ in some type of bond and are waiting for it to mature than cash out when it reaches $100 million

  6. RUEBEN E VEGA says:

This is Ridiculous, Its July 5th 2018 already and nothing!!WTF WAS ACTUALLY DECIDED ON MARCH 22ND?? THIS IS BS!! LOL!!

    1. Sarah Reed says:

Same thing i was saying… Freaking ridiculous… I bet they are reading these comments laughing…smh

      1. Carolyn says:

I had to beg for restroom breaks because the property I was at didn’t have 2 guards on,so random employees covered me and there was no such thing as lunch break . You worked while you ate..

  7. Norman.Harrison says:

I’ve been associated with lawsuits against Allied Universal in the past and yes everyone that applied will get paid at best before the end of the year so don”t get nervous most weren’t expecting anything anyways…right??

    1. Trent says:

As someone who was with the company for many years I’ve estimated close to 2500. That’s a
Month of rent. I’m trying not to thInk about it but it would be a huge help right now.

      1. Drew says:

If you call the phone number on the upssettlement.com website. The law firm will check ur name in their system and tell you the amount you will be receiving. But it could be a little less or more depending on how many people filed a claim.

  8. RUEBEN E VEGA says:

It seems like nobody is getting anything, because the supreme court ruled against class action lawsuits recently

    1. Drew says:

When I called the law firm handeling this settlement. The guy told me that I should be getting a check in late July. But who’s knows now. Seeing that the website status is still stuck on “waiting to receive final confirmation order from the court” then they will schedule a time to mail the checks to people. Seems all parties are taking their sweet time. Because they will take care of themselves first before us.

  9. julie says:

    Any updates

    1. liz says:

check the website. They will post a date that the checks will be mailed out soon.
      per website: “SETTLEMENT UPDATE:
The Arbitrator has approved this settlement and at this time the Parties are waiting to receive the Final Confirmation Order from the Court. Once we receive this Order, we will be able to schedule a date for the mailing of the settlement payments. Please check back periodically for case updates and the payment mail date.”

  10. Dennis sellers says:

To be included in the action I think you have to work in that district or region. Every security company I’ve worked for has gotten sued for this.

Nature of job your only guard at site 40 miles from anywhere. Can’t leave no relief for breaks or lunch. I’m surprised security industry hasn’t asked for waiver on that law. But no excuse for not paying overtime!!!!
