ProFlowers.com floral arrangements

Provide Commerce Inc. d/b/a ProFlowers has agreed to settle a class action lawsuit alleging it failed to disclose that some of its floral arrangements are delivered in a box.

If you purchased a floral arrangement from ProFlowers.com in California between July 1, 2009 and April 30, 2016, you may be entitled to benefits from the floral arrangements class action settlement.

The ProFlowers class action lawsuit was initially filed in July 2013 by plaintiffs Danny Sozzi and Brett Long. The plaintiffs took issue with ProFlowers.com’s allegedly misleading statements and omissions about the floral arrangements advertised for sale on the website.

According to the ProFlowers class action lawsuit, ProFlowers.com depicted fully-assembled floral arrangements but instead the flowers were “delivered as a do-it-yourself kit in a box requiring assembly by the recipient.” Sozzi and Long maintain the website infers that the floral arrangements will be delivered to the intended recipient in the same condition as depicted in the photographs of the floral arrangements posted on the website.

ProFlowers.com denies any wrongdoing and maintains it fully disclosed to consumers that certain floral arrangements are delivered in a box. However, it has agreed to settle the flower delivery class action lawsuit to avoid the burden, expense and distraction of ongoing litigation.

In addition to providing a gift code that can be used to make a purchase at ProFlowers.com, Provide Commerce has also agreed to make certain modifications to its disclosures about its flower delivery methods. Specifically, it will modify product descriptions to indicate that a floral arrangement will be shipped in “custom ProFlowers packaging and gift box” and provide a link to the FAQ page which provides further detail about the manner of shipment. The Calendar page will also indicate that flowers will be shipped in a ProFlowers.com gift box.

The deadline to opt out of or object to the ProFlowers.com class action settlement is June 26, 2017.

Who’s Eligible

Class Members include anyone who, according to Provide Commerce’s records, ordered and paid for a floral arrangement from Provide Commerce at any time between July 1, 2009 and April 30, 2016 and provided a California billing address at the time of purchase.

    YES, CHRISTMAS 2015 , flowers were ordered and delivered but were NOT, NOT what was ordered and half dead also. Then again on MOTHER’S DAY 2014 flowers ordered were delivered after Mother’s day and NOT at all what was ordered.

    I made 2 purchases of flowers in 2015 and 1 in 2016. It was horrible. flowers missed the person and was not delivered on time and one was poor quality.

    I purchased from them paid almost 60.00 for garbage…wasn’t satisfied at all.my mom didn’t get the flowers I placed…very unsatisfied customer..I will never order from them again.

    I have moved twice in the last 3 years and although I did a change of address, I keep finding out about class action lawsuits that I am supposed to be a part of but are missing. I suspect I may not be getting their notices? Any advice? Hard to contact companies if I don’t know about the suit. This site helps.

    Never received the merchandise.
    I purchased through Groupon transaction never happened .

    see i live in pa. the flowers i got were dying and wasnt full like described and my mom had to do it all n wait 24 hours before putting in case. i wasnt happy pay 50 just for something i could have gotten at Walmart for 10. they tried to give me to buy another one but wasnt having it. they ended up refunding it all. and this all just happened for mothers day
