If you had a debit card from Bank of America or one of the banks listed above, and paid an Insufficient Funds fee or charge, Overdraft fee or charge, Returned Item fee or charge, or other similar fee or charge within five days of using an ATM or your debit card to buy something within the “Purchased From” dates below this settlement is for YOU! If you were charged an Over Limit fee or charge because of a debit charge which occurred sometime during your statement period you’re included in this class action lawsuit settlement as well. It’s a cash settlement of $78 per claimant. We know it’s less than many were hoping for, but it’s free money, so why NOT make your claim? Just hit the Settlement Administrator website, click on “Submit a claim online” on the left, read the terms and conditions and click on continue. Next you have to enter in all of your contact information and include your bank account number which had the fee(s) assessed to it. The form states you can include the address of the account holder instead of the account number, but it’s locked and won’t accept enough characters to enter in most addresses (it wouldn’t fit ours by way of a test.) Click Continue, read through the terms and conditions, enter in the text verification characters and click on SUBMIT! That’s it! How easy was that? Any questions? Class Action Lawsuit Settlement Amount(s): $35,000,000 minus $8,125,000 in attorney fees minus $10,000 in the lead plaintiff reward minus $2,500,000 in administrative costs (advertising the notice, settlement administrator expenses, etc.) = $24,365,000 to be distributed to class members. TCA Staff Tidbit: This is the first bank fee settlement that many people have been waiting for. Unfortunately it’s a small one. I know paid for then $78 in fees to B of A over the course of 15 + years as a customer, but some money is ALWAYS better then NO moolah. I think it’s great they made it an EASY claim. I submitted my claim already, and hope if you qualify you do to! As we list above, it’s fast, easy and shouldn’t take longer than 2 minutes to submit your claim online. Interestingly, they include the caveat in the settlement agreement that the organizations getting any left over funds CANNOT be ones that encourage the pursuit of litigation against financial institutions. Seems like a “Duh” moment to me, but I guess it needs to be included to cover B of A’s Heine. That would be a big bummer (understatement) to spend $35 million and have a charity that gets a portion of it come back and sue you a few years later. Wouldn’t that be bad karma? Is there bad karma in the lawsuit biz? Hmmm. Things to ponder. Anyway, as we stated, check it out. Make your claim,get $78 back.

    chase bank is the same way!!they also charge excessive overdraft fees!i really think this is a well thought out scam across the board with banks like bank of america and chase bank and i,m sure the other big banks!imagine how much money these banks can make doing this overdraft fee scam to many of their debit card users?!this scam probably nets these banks millions of dollars a year if not more!!these banks really need to be regulated much more than they are now so that this scam is ended once and for all.another scam some of these banks do is overcharging military personel on their mortgages chase was named in a news report for doing this very thing!yes there was a law suit in that case to and chase admitted to doing this!!these banks are NOT trustworthy and they love Deregulation!

    I was charged 16.00 / month for a checking account for approx. 20 years, they told me they were not suppose to charge me, it was a free account and refunded me only for 2 months. They also raised my credit card fees without me being late with a payment.

    BoA just charged me 4 overdraft fees right in a row….. i added and subtracted right… just not in the right order aparently. Talk about a bummer. thats 140$ in fees over 14 $. does that not seem rediculous. An overdraft fee shouldnt be 34 dollars. I personally think it should be maby 30% of the amount you overdrafted. However that would be fair and thats not what there about. :'(

    The Bank has not stopped its practices despite the initial settlement offered as a result of this lawsuit. I don’t have much experience with these types of legal matters… is a second class action suit in the works in response to these continuously egregious transgressions of private bank “policy”??? or is this an impossibility? I’ve already signed up for the site newsletter, bytheway.

    The 1st checking acct I ever had was in 1995 & it didn’t take long for me to catch on to boa’s bullsh–. So, 13 yrs later, while “mortgage shopping” for our 2nd home (our 1st was foreclosed in ’02 – my husband had been given a $79,000 loan making $7.50/hr) we decided to be “smart.” He was approved this time around for $120,000 loan, we chose a $62,000 foreclosure, & purposefully avoided ANY suggestions from our realtor to go to boa. 1 yr later, our mortgage co. has sold our loan w/o our knowledge to—yep, boa. Completely legal, too, not to mention sickening. We mailed our mortgage payment almost 2 wks ago & they still haven’t posted it. MY question — is how the hell to get out of owing THEM — Why can’t we refinance w/the same ease that the bank we 1st dealt w/did?!! Checked to see about paying it online to prove when we pd so they couldn’t hold the check….oh, sure, it’s possible…for $15 extra dollars per payment….now multiply that times 30 yrs.

    I am so glad to have found this site, I too am having problems with BoA. After two weeks and 9 overdraft fees I found someone that told me about their 12:00 am sorting process of highest to lowest amounts. The worst thing about the process is BoA online customer service offered a credit of a 3 overdrafts and asked that I go to a banking center to talk with a manager due to their limited ability for adjustments. When I talked to the manager she told me since I accepted the credits from the online representative there was no more that could be done and the system was locked out. I’m unemployed and trying to do the best with what I have, 9 overdrafts is currently 24% of my total monthly income, they just don’t seem to care!
