BNSF Railway Co. agreed to a $75 million BNSF settlement to resolve claims that it failed to comply with Illinois’ Biometric Information Privacy Act (BIPA) when collecting trucker fingerprints.

The BNSF BIPA settlement benefits truckers who registered their fingerprints using an auto-gate system at any of BNSF Railway Co.’s four Illinois facilities between April 4, 2014, and March 5, 2024.

According to the BNSF BIPA class action lawsuit, the railway company illegally collected trucker fingerprints at its auto-gate systems in Illinois without complying with BIPA. BIPA requires businesses to obtain written consent, provide specific disclosures and follow other regulations regarding biometric privacy, all of which BNSF allegedly failed to do.

BNSF Railway Co. is a large transportation company with about 37,000 employees.

The company hasn’t admitted any wrongdoing but agreed to a $75 million BNSF settlement to resolve the BIPA class action lawsuit.

Under the terms of the BNSF BIPA settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary depending on the number of participating class members, but each trucker is estimated to receive around $1,000.

The deadline for exclusion and objection in the BNSF settlement is May 7, 2024.

The final approval hearing for the BNSF BIPA settlement is scheduled for June 17, 2024.

No claim form is required to benefit from the BNSF BIPA settlement, but class members have until July 15, 2024, to update their contacts and submit tax information.
