Biomat, Talecris Plasma Resources and Interstate Blood Bank, all part of Grifols, agreed to a $16.75 million class action lawsuit settlement to resolve claims they violated the Illinois Biometric Information Privacy Act (BIPA) by scanning fingerprints without first getting consent.

The class action lawsuit settlement benefits individuals who scanned their fingers on a finger scanning device during the plasma donation process at either a Biomat USA or Talecris Plasma Resources center in Illinois between June 10, 2015, and June 10, 2022.

The settlement also benefits individuals who scanned their fingers on a finger scanning device during the plasma donation process at the Interstate Blood Bank plasma donation center in Illinois between April 8, 2016, and July 25, 2022.

Plaintiffs in the class action lawsuit say the plasma donation centers failed to get their consent before using technology that scanned their fingers. According to the class action, the donation centers violated BIPA.

Biomat, Talecris Plasma and Interstate Blood Bank are plasma donation centers. All three of these centers involved in the class action lawsuit are part of Grifols, a network of plasma donation centers around the country.

The plasma defendants haven’t admitted any wrongdoing but agreed to a $16.75 million class action settlement to resolve the BIPA allegations.

Under the terms of the BIPA settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary based on the number of claims filed.

According to the settlement website, a 55% participation rate would result in payments of around $300 per claimant. A 30% participation would result in $550 payments, while a 15% participation rate would result in payments of around $1,100.

The defendants also agreed to comply with BIPA requirements in the future, including obtaining written consent from plasma donors.

The deadline for exclusion and objection is May 22, 2023.

The final approval hearing for the settlement is scheduled for Aug. 24, 2023.

In order to receive a settlement payment, class members must submit a valid claim form by Aug. 4, 2023.

  1. Yang says:

CALL J.G. Wentworth 877-cash-now n get an advance. Thank me later

    1. John Doe says:

Lol it’s a little too late for that advice but thanks still.

  2. B Baker says:

Just want to say thank you to everyone for posting on this thread! It has been so helpful!!

  3. Erick silva says:

I just talked to someone from the number above and they said checks are going to be sent out tomorrow November 17th

    1. B Baker says:

Did they say anything about direct deposit or PayPal?

    2. Jennifer King says:

Did they say how much the check will be for?

      1. Yang says:

$507, just called n asked today.

  4. Alexander says:

I just talked to someone from their contact # above, and they said they are counting the 60 days from when the court notified them officially of the final ruling, which they said was 9/20/23.

So we should be getting checks starting Monday 11/20/23.

That being said, she also said they had not been given a date for disbursement yet, but that it would be by the end of the year.

I say if you don’t have your money by 11/20/23, or the end of that week at the latest, blow their shit up.

  5. Heather says:

Can we class action against this class action? Dont they legally have to send payments by the 60th day? I think it’s crazy you can not find any information on the case AFTER the final hearing

  6. Ashley Messamore says:

I filed my claim but never got my money does anyone know what I can do.

    1. Sara says:

They haven’t sent the money yet. The website hasn’t been updated either. When you email them they just say the payments will be sent over before the end of the year even though they should’ve been sent out 60 days after the settlement was approved on 8/24/23. I can’t find any public records of the case to see what the delay is due to either.

      1. B Baker says:

Does anyone know if the 60 days meant “business days”? If that’s the case, and my calculations are correct, we’d be looking at 11/16.

        1. Sara says:

I didn’t think about that! That could be the case. This is what they emailed me in October:
          “Thank you for your email,

The settlement has received final approval. Payments will be issued before the end of the year, the specific date has not been determined yet.

          Sincerely,
          Office of the Claims Administrator“

It was pretty vague so not sure.

      2. Kathryn Taylor says:

I called and spoke to a representative and was told payments will begin going out November 17th.

  7. Darren talen says:

Does anyone have any idea how much the check will be for?

  8. John Doe says:

I left another email with the settlement administrator. I’ll update and let you guys know what was said.

    1. Norman Willeke says:

When will I get my settlement case

    2. Thomas says:

Let me know where you are emailing and I will join you. This is starting to get a little ridiculous. It’s been 60 days already. I thought these guys were supposed to be “the professionals”.

      1. John Doe says:

They stated in a very obviously generic email that they would be sent before the end of the year.

        1. Charlotte Davidson says:

Same response Ive gotten, they wouldn’t even answer the question that the court papers state 60 days after the Aug 24th approval date. Someone else I know emailed them and got a different response, they asked for his name and address so they could look in the database and then was told they haven’t set a date, didn’t even say before the end of the year, pretty shady!

  9. John Dim says:

Everyone should keep emailing them and urging them to send them out!

  10. John Doe says:

Everyone should keep emailing them and urging them to send them out!

    1. John for says:

For real though it feels like we’ve been waiting forever
