Avis Budget Group agreed to pay $45 million to resolve claims it charged renters hidden fees for electronic toll payment services.

The settlement benefits individuals who rented an Avis or Budget vehicle and paid Avis, Budget or Highway Toll Administration — an electronic toll processing administrator — for the use of e-Toll services between April 1, 2007, and Dec. 31, 2015. For rental transactions originating in Florida, Texas, and Colorado the class period is March 2, 2009, to Dec. 31, 2015.

Avis Budget Group is a car rental company that operates Avis, Budget, Zipcar and other car rental brands around the globe.

This lawsuit is about certain fees and toll-related charges associated with the “e-Toll” electronic toll payment system available for use by Avis and Budget rental vehicle customers. The plaintiff alleges the defendants breached the ABG rental agreement or the implied covenant of good faith and fair dealing by collecting these charges from customers in violation of the terms of the ABG rental agreement; violated the New Jersey Consumer Fraud Act by failing to disclose these fees; and caused unjust enrichment in the defendants’ favor. The defendants deny all of the allegations in the litigation and believe the claims asserted against them are without merit.

Avis Budget hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $45 million class action settlement.

Under the terms of the settlement, class members can receive partial reimbursement of eligible e-Toll-related charges. This includes e-Toll convenience fees and toll differentials.

For each class member’s first and second rental transaction, the settlement provides 80% reimbursement for eligible e-Toll charges. For a class member’s third through seventh rental transaction, the settlement provides 65% reimbursement of eligible e-Toll charges. Payments may be reduced if class members were previously refunded by Avis Budget or paid by a third party through a central billing account.

Exact payments will vary depending on the number of rental transactions claimed by class members and the amount they paid in e-Toll charges for each transaction. According to the settlement, average settlement amounts are projected between $9.36 for one rental transaction and $46.07 for seven rental transactions.

The deadline for exclusion and objection is Dec. 24, 2022. 

The final approval hearing for the Avis Budget toll fees settlement is scheduled for Feb. 23, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Feb. 28, 2023.

    I get so dam sick and tired of these dang attorneys always having certain state’s accessible only to these class actions like wtf do u mean. These dam fools done did all customers in all states like that and that’s for the rest of the class actions that they wanna exclude hella people from and process certain states. I Kno why they do it like that, cause if they were to file on all states thats too many clients for sure to sign up snd forsure that’s cutting into their whopping 28million and the clients that really suffered and went through something be getting $11.13, $20.99 a gift card or maybe $100 on a good 3 rounder. Believe me the ones that get paid the checks that say $1k or more best of believe that it wasn’t that many people filled a claim out. They absolutely put a huge stop to that and started having people put the claim id that was mailed to them in order to fill a good one out. Smh not sounding silly no more tdlking about add me!
