Benicar settlement gastrointestinal sprue like enteropathy olmesartanA Class of AT&T corporate training managers has accused their former employer of not paying proper overtime by misclassifying them and have asked for a $2.75 million employment class action settlement.

Recently, a class of roughly 300 former managers has asked a California federal judge to approve this employment class action settlement because they believe that AT&T violated the Fair Labor Standards Act by misclassifying them as independent contractors rather than employees.

This request for preliminary approval was made to U.S. District Judge Vince Chhabria.

In 2015, named plaintiffs Wendell W. and Michael M. sought to represent a Class of managers for AT&T who instructed other AT&T employees about outside vendors and company policies. These managers, according to the plaintiffs, were classified as contractors so they would be exempt from overtime pay.

Last September, Judge Chhabria certified a nationwide Class for this lawsuit–technically, an FLSA collective action. To date, nearly 100 members have opted in. According to Law360, this recent request for the $2.75 million employment class action settlement also seeks a conditional class certification for the Class for settlement purposes.

This Class includes several different categories of employees and former employees of AT&T. The requested employment class action settlement would be available to nearly 50 managers who have worked in California since May 2011 and who did not sign an arbitration clause in their employment agreement.

The employment class action settlement would also be available to about 70 employees who do not live in California, worked after May 2012, but have also opted into the class action lawsuit against AT&T. Also, 189 additional employees who worked for AT&T outside of California after 2014 but have not yet opted in may receive part of the employment class action settlement.

Interestingly, this request for the $2.75 million employment class action settlement sets up a non-traditional structure. It asks for a “hybrid fund” that, according to Law360, “is both a common fund for California class members and FLSA opt-ins and a claims-made fund for out-of-staters who could but have not yet asserted a claim under the FLSA.”

The Fair Labor Standards Act ensures that United States workers are fairly paid for all hours worked. It establishes regulations for how many hours an employee may work in a day and week, regulations for overtime pay and minimum wage and lays out which types of employees are “exempt” from these regulations and which are not.

Attorneys for the plaintiffs in this case assert that while this unusual structure for an employment class action settlement is complicated, it allows for the best results for the class members.

After Private Attorneys General Act payments, lawyers’ fees (capped at 1.2 million), witness service awards, and settlement administration costs, this $2.75 million employment class action settlement will pay out 85% to existing Class Members.

Fifteen percent will be set aside for future opt-in Class Members, and claims will be calculated based on number of workweeks, job titles and location.

This FLSA Lawsuit is Case No. 3:15-cv-03653, in the U.S. District Court for the Northern District of California.

    I had an AT&T contract for internet service in 2016 while living in Ponte Vedra Beach Fl. Two of the 7 months there was no Internet service and the other months it was intermittent. When I called about the problem there was a local service representative who came out and And replace the router twice claiming that it was a router issue never an Internet service problem.
