Arco Am Pm class action lawsuit

A class action settlement has been reached in the Arco AmPm debit card fee class action lawsuit. According to court documents, an Oregon jury determined that BP West Coast Products LLC (or BPWCP) charged consumers more for gas than what the consumer actually pumped or that was registered at the pump’s meter. Additionally, the jury also found BPWCP did not properly disclose its prices for gas when the company charged consumers a debit card transaction fee if they used a debit card to pay for gas at Arco stations located in Oregon.

This Arco AmPm debit card class action lawsuit was originally filed by plaintiffs in December 2011 and alleged that Oregon Arco and Am-Pm mini market gas stations would charge an extra fee for debit and credit card transactions, about 35 to 45 cents per transaction. Some of the Arco and Am-Pm featured stickers at the pump informing consumers of the debit card fee, but some did not warn customers of the fee at all. According to the plaintiffs, since Arco and AmPm did not make a practice of being “clear and conspicuous” with its debit card fee notices, the companies have violated the Oregon Unlawful Trade Practices Act, among other laws.

BPWCP has denied the claims brought against them in this Arco AmPm debit card fee class action lawsuit and plans to appeal the verdict reached by the Oregon jury.

Who’s Eligible

You are a Class Member of the Arco AmPm debit card class action settlement if:

  • You purchased gas at Arco or Arco AmPm in the State of Oregon between the Class Period of Jan. 1, 2011 through Aug. 30, 2013, and
  • You paid for the purchase using a debit card and were charged a debit card transaction fee
Potential Award

Under the Settlement, Defendant agrees to pay to each Class Member 100% of the total base amount each Class Member is entitled to under the May 2016, Amended General Judgment of the Court, plus 3% interest accruing from June 1, 2016, in two payments. Each Class Member will receive a total of at least $185.00, which will be split into two payments, the first payment within 30 days from July 15, 2019 and the second payment within 30 days from July 15, 2020. In the event that court proceedings to review and approve the Settlement continue longer than is currently expected, one or both payments may be delayed until after the court proceedings conclude.

Proof of Purchase

According to the Arco AmPm class action settlement website, if you did not receive notice that the records available reflect that you are a qualifying Class Member, you will need to submit a claim form that requires information about you, your Arco AmPm purchase, and the debit card you used to make the gas purchase.

    All appeals exhausted as of October of 2015 but stil almost a year later and still no word. Hmm, even with the lawyers fees worked out, BP is still dragging their feet. It really ticked me off when I read they are only paying 19% of the profit that they made doing this illegal pratice. Jesus, what criminals. I wish I could go rob a bank or every BP gas station knowing it is wrong and only have to pay back 19%. I hate corporations. How they get away with this level of corruption is just beyond me.

    It’s my understanding that this case is going through appeals now and it could take a few yrs before we see any monies. Also, I read someplace that interest would be charged if not paid by a certain date. Sorry folks can’t remember any of the other details. Hope this somewhat helps!

    I filed all of the proper things…but have not ever heard anything more about repayment, what is going on with this case? Have they payed people yet, and if so, how can I find out where my payment is?

    It is not a Oregon resident only lawsuit! I was on vaca in Oregon and used my debit card in many of these gas stations in that state! James please READ!

    I also received a letter and it’s now June n decided to research the Web on this but by the looks of it. There’s lots of us who haven’t received anything. That $160 sure would come in handy for something small this Summer with my kiddos..

    This could drag on for a while–am/pm will find ways to appeal & appeal & appeal. I am sure they have some pretty smart lawyers working on this case.

    I received a notice about this and did not do or file anything as the letter stated I did not have to do anything to receive a payment. How long might this take and is there any forms I need to fill out to receive this money.

    I believe am pm is appealing the decision. It might be awhile before anyone gets anything.
