AppFolio recently agreed to pay $4.5 million to resolve class action claims that the rental property company violates federal law by not clearly identifying the source of the information it provides on consumers’ credit reports.
Settlement Class Members include individuals who, between Sept. 27, 2015 and Aug. 10, 2018, were the subject of a consumer report prepared by AppFolio that contained public record information.
Also included in the settlement are those who made a request for their information from AppFolio and had the company send them a copy of the consumer report provided to a third party.
Plaintiff Anthony Leo filed a class action lawsuit against AppFolio Inc. claiming that the company violated the requirements of the Fair Credit Reporting Act (FCRA).
The FCRA is a federal law that ensures accuracy, fairness, and privacy of consumer information in reports.
Leo claims that AppFolio violated the FCRA by selling tenant screening reports to third parties and failing to provide sufficient disclosures of information upon request.
AppFolio does not admit any wrongdoing in settling the class action lawsuit against them. Instead, the settlement provides an opportunity for all parties to resolve the case without the costs and risks of continuing litigation.
Under the settlement, AppFolio has agreed to make changes to their procedure to ensure maximum accuracy in screening reports and better disclosures.
Class Members will be able to collect a pro rata portion of the settlement with the specific amount determined by the number of valid claims filed. Class Members have until May 10, 2019 to file a valid claim.
The objection and exclusion deadline for the settlement is May 10, 2019. The final approval hearing is scheduled for July 18, 2019.
