Consumers who purchased AmeriGas or Blue Rhino pre-filled tanks may be eligible to claim up to $125 without proof of purchase as part of a $6.5 million settlement over the amount of propane in the tanks.

Those who are eligible to make a claim in this class action settlement include individuals who bought or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks between Dec. 1, 2009, and Nov. 30, 2020.

Without proof of purchase, Class Members will be eligible for up to $2.50 per tank for up to 50 tanks, or $125.  Class Members who provide proof of purchase are eligible for up to $5 per tank, with no limit on the number of tanks that can be claimed.

This class action settlement resolves claims that AmeriGas and Blue Rhino allegedly colluded together to lower the amount of propane in their pre-filled propane tanks from 17 pounds to 15 pounds without also reducing the price, resulting in inflated prices for propane customers.

While consumers who purchased either AmeriGas or Blue Rhino propane tanks may be affected by this settlement, it only resolves the claims made against AmeriGas; the Blue Rhino case is continuing in court.

AmeriGas has agreed to end the litigation with this settlement, but AmeriGas does not admit to any wrongdoing. 

The settlement agreement established two Classes.

The Indirect Purchaser Settlement Class is made up of those who purchased AmeriGas or Blue Rhino propane tanks, other than a wholesale purchase directly from AmeriGas or Blue Rhino for resale, in Arizona, California, Iowa, Maine, Michigan, Minnesota, Nevada, New Mexico, North Carolina, North Dakota, South Dakota, Utah or West Virginia during the Class Period.

The Direct Purchaser Settlement Class is made up of consumers nationwide who purchased one of the propane tanks directly from AmeriGas or Blue Rhino via a vending machine at retailers or other locations, or paid one of the companies directly through a vending machine to exchange a previously purchased propane tank, other than a wholesale purchase intended for resale.

A fairness hearing is scheduled for March 31, 2021.

The deadline for filing a Claim Form, opting out or objecting to the settlement is March 8, 2021.

Who’s Eligible

Potential Award
  • With proof of purchase, Class Members will be eligible to claim a cash payment of $5 for each tank purchased. There is no limit to the number of tanks that may be claimed with proof of purchase.
  • Without proof of purchase, Class Members may claim $2.50 for each tank, up to 50 propane tanks, for a maximum of $125.
Proof of Purchase

Valid forms of proof of purchase include store receipts, credit card receipts, UPC codes from propane tank labels and store records. Consumers with something else they think confirms the purchase should submit it along with their Claim Form. The Claims Administrator will determine whether the proof is sufficient.

    In July 2021 I emailed them my new address. They sent me a confirmation email. I sent another email claiming that I’m still waiting for my check. They replied with sorry it’s too late. Class action is closed. From all the other comments, I’ve concluded that they line their pockets with money that they never planned on sending. I’ve decided this is all a scam.

      They said they sent me a check I never received so it took months to get a second one and the name was all wrong there’s no way it could have been mine so I emailed them again with a picture of the check well I was just informed on the 8th that a check was sent out on the 7th we’ll see. The funny part is when I called to see if they had the right address in the first place because I had moved they said they couldn’t even find my claim LOL these people are something else…

    I have been trying to get a hold of someone and I got the virtual card for my payment in August I opted for an actual plastic card and I still have yet to receive it. I have called twice to the company that has the card and they said they sent it out the first time which was the beginning of September said it was sent out August 20th, and it would be 15days and actually the day I called was day 14 the lady on the phone had said. The I called again the middle of September and they told me that they are behind on making the cards and someone would call
    me in 5 days (which I didn’t understand) I have not heard anything back or received my card. Could someone please tell me what is going on? Where are our payments?

    They keep sending my check to the wrong address first tow times there was no appartment number then they sent it to an address I live at 2 yrs ago. Even though I called several times to make sure they had the right address. I’m going to call again tomorrow and see who I need to talk its ridiculous.

    Received a check today, but it doesn’t belong to me. It was sent to my address, but it’s for a Linda Gray. Have no idea who this person is, went on website but it’s unavailable for me notify them. Does anyone have any suggestions on how to contact them?
