Consumers who purchased AmeriGas or Blue Rhino pre-filled tanks may be eligible to claim up to $125 without proof of purchase as part of a $6.5 million settlement over the amount of propane in the tanks.

Those who are eligible to make a claim in this class action settlement include individuals who bought or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks between Dec. 1, 2009, and Nov. 30, 2020.

Without proof of purchase, Class Members will be eligible for up to $2.50 per tank for up to 50 tanks, or $125.  Class Members who provide proof of purchase are eligible for up to $5 per tank, with no limit on the number of tanks that can be claimed.

This class action settlement resolves claims that AmeriGas and Blue Rhino allegedly colluded together to lower the amount of propane in their pre-filled propane tanks from 17 pounds to 15 pounds without also reducing the price, resulting in inflated prices for propane customers.

While consumers who purchased either AmeriGas or Blue Rhino propane tanks may be affected by this settlement, it only resolves the claims made against AmeriGas; the Blue Rhino case is continuing in court.

AmeriGas has agreed to end the litigation with this settlement, but AmeriGas does not admit to any wrongdoing. 

The settlement agreement established two Classes.

The Indirect Purchaser Settlement Class is made up of those who purchased AmeriGas or Blue Rhino propane tanks, other than a wholesale purchase directly from AmeriGas or Blue Rhino for resale, in Arizona, California, Iowa, Maine, Michigan, Minnesota, Nevada, New Mexico, North Carolina, North Dakota, South Dakota, Utah or West Virginia during the Class Period.

The Direct Purchaser Settlement Class is made up of consumers nationwide who purchased one of the propane tanks directly from AmeriGas or Blue Rhino via a vending machine at retailers or other locations, or paid one of the companies directly through a vending machine to exchange a previously purchased propane tank, other than a wholesale purchase intended for resale.

A fairness hearing is scheduled for March 31, 2021.

The deadline for filing a Claim Form, opting out or objecting to the settlement is March 8, 2021.

Who’s Eligible

Potential Award
  • With proof of purchase, Class Members will be eligible to claim a cash payment of $5 for each tank purchased. There is no limit to the number of tanks that may be claimed with proof of purchase.
  • Without proof of purchase, Class Members may claim $2.50 for each tank, up to 50 propane tanks, for a maximum of $125.
Proof of Purchase

Valid forms of proof of purchase include store receipts, credit card receipts, UPC codes from propane tank labels and store records. Consumers with something else they think confirms the purchase should submit it along with their Claim Form. The Claims Administrator will determine whether the proof is sufficient.

    my husband ad I have bee using the tank exchange for last 7 years to heat our camper and to cook on. we usually go through one every 2 weeks and Unfortunately we don’t think keep receipts and most the time we pay cash since we don’t have a bank account would we be eligible for this settlement

    Amerigas is a terrible business even for residential propane.

    This company has got to be the worst on all levels. To start I was getting charged 3 times the rate for propane. Please make sure you do your homework before continuing to purchase propane from this company. Amerigas charged me $100 every year in addition for rental fees on the tank. If you need any help from customer service expect to wait 30 minutes to and hour for anyone to answer. I have called and got hung up on multiple times which I then needed to wait all over again. Please make sure that you have them send confirmation emails back to you. It took them two full months to pick up their tank. I traveled 3 hours and waited all day just to call and find out they never had it on the schedule and the lady I talked to set it up. When they finally picked up their tank I got charged $204 for pickup or $124/per hour. I was told multiple times on the phone that there would be no charges because of their mistake. This company is money hungry and will bend you over any way they can to get it.

      I have been going rounds and rounds with these people! They keep taking me off their delivery route because “the driver is over booked” all while my tank is empty! No heat in this house in the dead of winter even though my bill is paid. I’m on “automatic delivery” and have to call and call and call every time! This month they have just been 100% Uncooperative, I’ve sent emails, on the phone with them every morning for over a week and still no refill. ENRAGED AND FREEZING in Ohio!

        If your registered to vote I would contact start with 1. public utility commision, 2. City department that issues business liscences. 3 &4 State Senator & Congressperson. Then explain the problems your having with AG and ask them to contact AG and request explanations and that all future deliveries are made before your tank is even near empty.
        You’ll be amazed at how effective an inquiry from one or more of the above can be to fix things.
        No one in management wants a second call from a Senators office to explain why it happened again. It has worked for me. Good luck.

          I am having the same problem and my family just got over Covid 19
          Who can I call to get results.live in Andover Nj and out of heat for 2 days now..we called A.merigas and they could care less. We have to pay them additional $300 to get propane in 2/3 days, if that. We called and placed delivery when our tank was at 30% and they refuse to deliver to us until we pay the addl fee of $300. very disappointed!! Kids are sick all over again.

      I’ve been buying blue/ rhino propane tanks off and on since 2010 due to the fact that I was restoring my sister house which had no electricity but had a propane tank which had a leak and regulations says you have can’t get. Propane so during the winter months I would just buy/exchange blue rhino propane tanks at the local gas station since 2010 of course I never kept receipt so I should be eligible for compensation right???

    Does anyone know how to fill out the downloaded form for over 30 tanks? I have no idea how to use it and do I write in each separate date 50 times? So confused why they would do it this way…

    It says you can file for up to 50 w/o proof of purchase it when you try the firm for 30 or more it requires proof, so we are suppose to file 50 separate claims here??? Are you kidding me??
