If you received an unwanted automated phone call on your cellular telephone from A&B Insurance and Financial Inc. between Aug. 18, 2012 and April 26, 2017, you may be entitled to benefit from a $4.25 million class action settlement agreement.

Lead plaintiffs accused A&B Insurance of contracting with third parties to call consumers’ cell phones using an autodialer and/or prerecorded messages. The plaintiffs said that this violates the Telephone Consumer Protections Act (TCPA). Further, the plaintiffs alleged in their class action lawsuit that A&B also called phone numbers listed on the “Do Not Call Registry.”

Enacted in the early 1990s, the TCPA strictly limits the use of telephone, fax, and, more recently, text messages for advertising purposes. Specifically, the federal law prohibits the use of automatic dialers and prerecorded messages to contact consumers without their prior express consent.

The Act also created the “Do Not Call Registry” that consumers can use to notify companies that they do not want to be contacted with advertising via the phone number they register.

Companies that are caught violating the TCPA can face stiff penalties, including fines ranging from $500 to $1,500 per violation.

A&B Insurance admits no wrongdoing under the terms of the class action settlement.

Class Members have until July 9, 2018 to opt out or exclude themselves from the terms of the settlement.

Who’s Eligible

Class Members include those whose phone numbers were on the class list and were contacted without permission regarding A&B services between Aug. 18, 2012 and April 26, 2017. Covered phone calls include those that used an automatic telephone dialing system or a prerecorded voice; as well as telemarketing calls made to phone numbers on the national Do Not Call Registry.

    I received a check as well – payable to “Class Member” in the amount of $163.
    State: Florida.
    However, our bank will not cash the check without my name on it. Clearly, my phone number was part of the Class Member’s List, but cannot access due to the closure of the case.
    Any advice with respect to the bank not depositing the check? Thoughts?
