A $550,000 Albany ENT & Allergy Services settlement resolves claims that the health care provider failed to protect patients and employees from a 2023 data breach.

The settlement benefits individuals whose personal information the Albany ENT & Allergy data breach compromised in March or April 2023.

Plaintiffs in the data breach class action lawsuit claim ransomware groups were able to hack Albany ENT & Allergy Services’ systems in 2023 because of the company’s relaxed cybersecurity measures. Hackers allegedly stole patient and employee Social Security numbers, birth dates, medical information and more.

Albany ENT & Allergy Services is a specialized ENT clinic in New York.

Albany ENT & Allergy hasn’t admitted any wrongdoing but agreed to pay up to $550,000 to resolve the data breach class action lawsuit.

Under the terms of the Albany ENT & Allergy Services settlement, class members can receive up to $7,500 in reimbursement for documented data breach-related losses. Class members without document expenses or those who do not wish to claim reimbursement may instead choose to receive a one-time cash payment of $50.

Regardless of which payment option class members choose, they can also claim two years of free three-bureau credit monitoring and identity theft protection services.

In addition to funding this settlement, Albany ENT & Allergy made changes to its cybersecurity practices to better protect patient and employee data. These changes include enhanced multi-factor authentication, managed detection and response, additional encryption, improved log retention and a new incident response plan.

The deadline for exclusion and objection was Sept. 23, 2024.

The final approval hearing for the settlement is scheduled for Oct. 16, 2024.

To receive Albany ENT & Allergy Services settlement benefits, class members must submit a valid claim form by Oct. 23, 2024.
