A $400,000 Pacific Cataract & Laser Institute class action settlement resolves claims a data incident compromised the personal information of thousands of individuals.

The Pacific Cataract & Laser Institute settlement benefits individuals who received a data breach notice from Pacific Cataract & Laser Institute informing them their information may have been compromised in a cyberattack that occurred in November 2023 and was announced in March 2024.

The data breach class action lawsuit involves a data incident in which unauthorized individuals allegedly accessed private information, including names, Social Security numbers, dates of birth, medical record numbers, health insurance policy numbers and medical history details. According to the plaintiffs, Pacific Cataract & Laser Institute failed to implement and maintain reasonable security measures necessary to protect the private information it maintained on its database.

Pacific Cataract & Laser Institute is an eyecare facility that performs cataract corrections, LASIK and other eye procedures.

Pacific Cataract & Laser Institute hasn’t admitted any wrongdoing but agreed to pay $400,000 to resolve the data breach class action lawsuit.

Under the terms of the Pacific Cataract & Laser Institute settlement, class members can receive up to $5,000 in reimbursement for documented out-of-pocket losses or expenses related to the data breach. Additionally, they may receive a pro rata cash payment, which is estimated to be around $150 per claimant but may be adjusted depending on the funds available.

The deadline for exclusion and objection was Oct. 23, 2024.

The final approval hearing for the settlement is Dec. 13, 2024.

To receive Pacific Cataract & Laser Institute data breach settlement benefits, class members must submit a valid claim form by Nov. 12, 2024.
