HealthAlliance agreed to pay $1.29 million to resolve claims related to a 2023 data incident that compromised the personal details and health information of approximately 260,000 patients.

The HealthAlliance settlement benefits individuals who received a data breach notice from HealthAlliance informing them their personal information may have been impacted in the cybersecurity incident that occurred between Aug. 18, 2023, and Oct. 13, 2023.

The class action lawsuit alleges HealthAlliance failed to adequately protect the personal information of its patients, resulting in a data breach that compromised sensitive information. The HealthAlliance data breach allegedly exposed sensitive information, including patient names, addresses, Social Security numbers, financial information and health-related records.

HealthAlliance is a health care company that operates several hospitals and clinics around the country, including Margaretville Hospital in New York, HealthAlliance Hospital in Minnesota and other members of the Westchester Medical Center Health Network.

HealthAlliance hasn’t admitted any wrongdoing but agreed to pay $1.29 million to resolve the data breach class action lawsuit.

Under the terms of the HealthAlliance settlement, class members can either receive reimbursement for data breach-related losses or an alternative cash payment.

Class members can receive up to $7,500 per person for ordinary losses, which may include out-of-pocket expenses such as bank fees, long-distance phone charges, cell phone charges, data charges, postage or gasoline for local travel and fees for credit reports, credit monitoring, or identity theft insurance products. They can also receive compensation for lost time of $25 per hour up to four hours. Extraordinary losses may be compensated if they are documented, unreimbursed monetary losses due to fraud or identity theft.

Class members without documented expenses or those who don’t want to claim reimbursement can instead receive a flat payment of $100.

All class members are eligible for three years of free credit and medical monitoring offered under Medical Shield Complete by CyEx. These services are valued at $179.40 per year.

All settlement payments may be increased or decreased on a pro rata basis depending on the claims filed.

The deadline for exclusion and objection was Nov. 4, 2024.

The final approval hearing for the settlement is scheduled for Dec. 4, 2024.

To receive settlement benefits, class members must submit a valid claim form by Nov. 19, 2024.
