Evangers hunk of beef can

Evanger’s has agreed to pay $545,500 to resolve class action claims that their pet food is dangerous to animals due to poisonous ingredients.

The settlement benefits individuals who purchased Evanger’s Hunk of Beef, Evanger’s Braised Beef or Against the Grain Pulled Beef with Gravy between Dec. 1, 2015 and June 30, 2017.

Plaintiffs Nicole and Guy Mael filed their Evanger’s class action lawsuit in June 2017, claiming the products contained a dangerous chemical. The dog food allegedly contained pentobarbital, a drug used to euthanize animals, execute humans and conduct physician-assisted suicide.

The couple say that they fed their five dogs Evanger’s dog food for years. In 2016, the dogs were reportedly fed Hunk of Beef and Pulled Beef dog food and quickly fell ill with neurological symptoms.

Although the couple rushed their dogs to the vet, one of the dogs reportedly died the next day. The remaining four dogs eventually recovered but allegedly require continued care such as anti-seizure medication.

Evanger’s has not admitted to any wrongdoing but has agreed to resolve the claims against them for $545,000.

Under the settlement, Class Members can collect either a cash payment or merchandise certificates with proof of purchase. The cash payment would be 25 percent of the purchased products’ value while the merchandise certificates would be 50 percent of the purchased products’ value. Without proof of purchase, Class Members can receive three free cans of Evanger’s or Against the Grain products.

If Class Members’ animals got sick after eating Evanger’s food and needed veterinary care, affected individuals are able to submit a claim for veterinary expenses. An impartial veterinarian will review the necessary records to determine a claimant’s eligibility.

In order to benefit from the settlement, Class Members need to submit a valid claim form by March 9, 2020. The deadline for exclusion and objection is also March 9, 2020. The final approval hearing for the Evanger’s class action settlement is scheduled for May 8, 2020.
