Checks and payments are being sent to consumers who purchased one of several Simple Green cleaner products between May 12, 2016, and May 17, 2021.

According to two class action lawsuits against Simple Green manufacturer Sunshine Makers Inc., the cleaning products were misleadingly advertised as “non-toxic.” Settlement Class Members allegedly paid more for Simple Green cleaners based on these advertisements.

Sunshine Makers didn’t admit to financially injuring consumers through false advertisements, but agreed to settle the class action lawsuits against them with a $4.35 million settlement.

Under the terms of the settlement, Class Members could submit a claim for up to $30. The settlement terms allowed consumers to claim reimbursement of up to $3 per purchased product and up to 10 products total.

In order to benefit from the settlement, Class Members were required to submit a claim form by Aug. 16, 2021. Individuals who submitted valid claim forms are now receiving payments for $20.45 via checks in the mail or electronic rebates through PayPal, Venmo, and Zelle.

The settlement Class is represented by Ryan J. Clarkson, Katherine A. Bruce, and Lauren E. Anderson of Clarkson Law Firm PC along with Christopher D. Moon and Kevin O. Moon of Moon Law APC.

The two Simple Green Class Action Lawsuits are O’Brien, et al. v. Sunshine Makers Inc., Case No. CIV-SB-2027994 in the Superior Court of the State of California, County of San Bernardino, and Moran, et al. v. Sunshine Makers Inc., Case No. 4:20-cv-03242 in the U.S. District Court for the Northern District of California.

Fresh Milk Price Fixing Settlement Payouts

A second settlement distribution of $18.90 has reached consumers who filed a claim in a fresh milk antitrust class action settlement.

The settlement benefited a wide range of consumers who, since 2003, purchased milk or other fresh milk products such as half & half, cream cheese, sour cream, cottage cheese, yogurt, and cream in certain states.

According to the fresh milk class action lawsuit, companies such as Cooperatives Working Together (CWT), Dairy Farmers of America, Land O’Lakes, Dairylea, and Agri-Mark worked together to artificially raise the price of milk products. Dairy farmers allegedly entered into an antitrust agreement with CWT to raise the cost of raw milk by prematurely slaughtering cows. As a result of this agreement, the cost of consumer-end milk products increased as well, according to the class action lawsuit.

The defendants did not admit to violating federal antitrust laws with a price-fixing agreement but agreed to settle the claims against them with a class action settlement.

Although exact payment estimates were not available before distributions, the $52 million settlement was to be split amongst Class Members based on how much milk they purchased for their household. In order to receive payment, Class Members had to file a valid claim form by Jan. 31, 2017.

The first settlement distribution occurred in September 2021 and resulted in payments of up to $7.61. According to a payment update, Class Members who submitted a valid claim with the settlement received a second distribution of $18.90 in the form of a digital Virtual Mastercard between Jan. 1 and 5, 2022.

Plaintiffs and the Settlement Class are represented by lawyers from Hagens Berman Sobol Shapiro LLP.

The Fresh Milk Antitrust Class Action Lawsuit is Matthew Edwards v. National Milk Producers Federation, Case No. 4:11-cv-04766-JSW in the U.S. District Court for the Northern District of California.

Top Class Actions readers are receiving settlement checks as high as $102.21 in connection with a citronella candle pest control class action settlement.

The settlement benefited consumers who purchased EPA-registered citronella candles or toal release foggers from Cutter and Repel, Black Flag, Do It Best, Eliminator, Green Thumb, Hot Shot, No Pest, Real-Kill, Rid-A-Bug, Spectracide, and TAT brands between May 4, 2015, and June 7, 2021.

According to plaintiffs in the pest-control class action lawsuit, marketing company United Industries Corp. used false advertising to promote the products listed above. Marketing claims allegedly promised high performance from the citronella candles and foggers, but failed to reflect the realistic efficacy of the products.

United Industries did not admit any wrongdoing but agreed to settle these claims with a $3.6 million settlement.

Class Members were projected to receive payments of up to $14 without proof of purchase or a full refund with proof of purchase. In order to receive payments, Class Members must have submitted a valid claim form by Sept. 20, 2021.

Consumers who submitted a valid claim form have started to receive payments, according to comments from our readers. Top Class Actions viewers have reported payments from $14 to as high as $102.21.

The Settlement Class is represented by lawyers from Steelman & Gaunt, Kamberlaw LLC and Bursor & Fisher PA.

The Pest Control Class Action Lawsuit is Christine Mendoza, et al., v. United Industries Corporation, Case No. 21PH-CV00670 in Phelps County Circuit Court, Missouri.
