KeyBank data breach class action lawsuit overview:

- Why: Bozin claims KeyBank bears responsibility for a July data breach due to its allegedly insufficient cybersecurity practices.

KeyBank caused, facilitated and exacerbated a July data breach by having “insufficient and unreasonable data security practices,” a new class action lawsuit alleges.
Plaintiff Daniel Bozin claims KeyBank, along with its property insurance verifier Overby-Seawell, holds responsibility for the exposure of its customers’ personally identifiable and financial information.
“The criminals gained unauthorized access by thwarting, circumventing and defeating Defendants’ unreasonably deficient data security measures and protocols,” the KeyBank class action states.
Bozin argues that some of the data stolen in the KeyBank data breach “consists of some of the most sensitive and damaging information when in the hands of criminals.”
Personally identifiable information, including names, mortgage account information, phone numbers and property information, among other things, were exposed in the data breach, according to the KeyBank class action.
KeyBank class action alleges information stolen can be used to harm customers
Bozin argues that the personal information stolen in the KeyBank data breach can be used to harm consumers in a number of ways, including damaging their money, reputation and creditworthiness, among other things.
KeyBank, meanwhile, uses their cybersecurity capabilities as a “selling point” with the company stating that “we take the security of your data and information seriously,” the KeyBank class action alleges.
Bozin claims KeyBank and Overby-Seawell are guilty of negligence and negligence per se. He demands a jury trial and requests declaratory and injunctive relief along with an award of actual damages for himself and all class members.
Bozin wants to represent a nationwide class and Ohio subclass of consumers who had their personally identifiable information accessed in the KeyBank data breach.
Capital One agreed to pay $190 million last month to resolve claims it jeopardized the information of its customers during a 2019 data breach.
Also last month, a federal judge in New York dismissed claims that Ally Bank was responsible for a leak that exposed the login information of its customers.
